HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 36708 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
HON'BLE SWARUPAMA CHATURVEDI, J.
1. Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
2. Petitioner before this Court claims to be the son of Mahant Late Puran Mal Goyal of the math in question which owns the mandir property known as 'Shiv Mandir' and is aggrieved for misappropriation of the property due to internal dispute regarding its management amongst those who are associated with Math and resident of the Math and rival claims of mahant. He further submits that he has already instituted a civil suit against those who are misappropriating public money that floods in from the disciples and also has instituted a suit for the purposes of title of the property so that the property doesn't get waisted at the hands of the outsiders.
3. However, upon pointed query being made, learned counsel for the petitioner could not demonstrate that the petitioner was at any point of time inducted in the Math by his late father as his chela (disciple). Petitioner also does not claim to be a mahant or in any manner associated with the management of the property except of the fact that he is the son of late mahant.
4. In our considered view, this matter raises serious dispute civil in nature as the petitioner is claiming any rights/title qua the property of Math which also houses a 'Shiv Mandir' and since he has already instituted a suit in that regard, we do not find any good ground to grant indulgence in this petition exercising our extraordinary jurisdiction under Section 226 of the Versus Counsel for Petitioner(s) : Kaushlendra Singh, Rashmi Singh Counsel for Respondent(s) : C.S.C. Mohit Kumar Goyal .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s)
Constitution, hence, we dismissed this petition with liberty to the petitioner to pursue his remedy before the civil court where his civil suit is pending consideration.
