HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL REVISION No. - 6460 of 2025 Court No. - 91 HON'BLE ABDUL SHAHID, J.
1. Heard learned counsel for the revisionist and the learned AGA for the State.
2. This criminal revision has been preferred challenging the impugned
order dated 20.8.2025, passed by Additional Civil Judge (JD)Court No.4/Judicial Magistrate, Muzaffarnagar, whereby the application filed under Section 156(3) Cr.P.C. has been rejected.
3. Learned counsel for the revisionist has submitted that all the opposite party nos. 2 to 11 with collusion of a conspiracy of each other made a fabricated unregistered will dated 15.3.1997 of Harbansh Singh. He also submitted that Harbansh Singh on that date i.e. on 15.3.1997 was in foreign and not in India. All the opposite parties 2 to 11 had fabricated his forged death certificate. He also submitted that even Harbansh Singh did not having any share in the property. He also submitted that on 29.4.2024 when the complainant/revisionist was going Meerapur about said will, then the opposite parties Sunil Nandwani and Rajendra Nandwani and three others objected him on the road and beaten him by fists and legs and tried to strangulate him and intimidated.
4. The issue raised by the revisionist appears to be of some property and unregistered will and forged and fabricated death certificate of Harbansh Singh. Said unregistered will is not on record.
5. Learned trial court has specifically given a finding in the impugned Versus Counsel for Revisionist(s) : Kulveer Singh Counsel for Opposite Party(s) : G.A. Gulshan Roy .....Revisionist(s) State Of U.P. And 10 Others .....Opposite Party(s)
order dated 20.8.2025 that the complainant did not file supporting documents with his application, by which the will may be declared as fabricated and forged. The revisionist-Gulshan Roy only stated that the said will is false and fabricated. The trial court has observed that the complainant-revisionist has not filed any medical report in support of alleged incident dated 29.4.2024. Learned trial court has also observed that as per the allegations made in the application, it appears that the complainant-revisionist tried to give colour of criminality to a civil dispute. Learned trial court has relied upon the law laid down by the Apex Court in Indian Oil Corporation Vs. M/s NEPC India Ltd and others.
6. Learned AGA has opposed the revision.
7. From the record, it appears that the basic dispute is the alleged unregistered will dated 15.3.1997 and false and fabricated death certificate of Harbansh Singh. The dispute, if any, is of civil nature and it has nothing to do with the criminal offence. The finding given by the learned trial court is correct.
8. In view of the above, this revision has no force and is liable to be dismissed.
9. The revision is, accordingly, dismissed. October 30, 2025 sfa/ CRLR No. 6460 of 2025 2 (Abdul Shahid,J.) Digitally signed by :- SYED FAHEEM AHMAD High Court of Judicature at Allahabad
