Petitioner claims to have been appointed as Assistant Teacher in an unaided school in the year 2005. The order of approval passed by Additional District Education Officer, Basic, Dehradun dated 31.03.2008 is on record as Annexure-4 to the writ petition. 4. Petitioner contends that her services have not been regularised and she is still getting salary from the management, while, the concerned school has been included in grant-in-aid list. Relief sought in the writ petition are as follows: - “i) A writ, order or direction in the nature of Mandamus directing/ commanding the respondent department to forthwith adjust/ regularize the services of the petitioner on the post of Assistant Teacher (Primary) in Swami Ramtirth Girls High School, Rajpur, Dehradun and release her salary from State fund with all service consequential benefits from the date when the said institution of the petitioner comes within the purview of grant-in- aid. ii) A writ, order or direction in the nature of Mandamus commanding/ directing the respondents to release the arrears of salary of the petitioner alongwith the interest of 18% per annum in favor of the petitioner.” 2025:UHC:11588 5. Learned State Counsel submits that petitioner has sought a writ of mandamus and she has also made a representation, therefore, decision on representation shall be taken by the competent authority as early as possible. 6. Learned counsel for the petitioner submits that petitioner be permitted to make fresh representation, highlighting her grievances. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make fresh representation to the competent authority, within two weeks from today. If petitioner makes such representation within the stipulated time, the same shall be decided, as per law, within four months thereafter.
