(Oral) Petitioner herein, who at present is working as TGT (Non- medical) at Government High School Choori, District Chamba, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation (Annexure P-4), whereby he has prayed for his transfer from present place of posting to one of the stations, as detailed in the representation, on account of his having completed normal tenure of posting in sub cadre area. 2. It has been averred in the petition, which is duly supported by an affidavit that petitioner has already completed normal tenure of posting at present place of posting and in terms of Transfer Policy formulated by the Government of Himachal Pradesh, he is entitled to be transferred to soft area or one of the stations of his choice. Though before coming to this Court, petitioner filed representation to the competent authority, but since nothing was done, he is compelled to approach this Court in the instant proceedings. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Mr. Kahol, fairly states that representation (Annexure P-4) filed by the petitioner, if not already decided, shall be decided expeditiously. 4. Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to the respondents to consider and decide the pending representation (Annexure P-4) filed by the petitioner expeditiously, preferably within a period of three weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders taking note of Transfer Policy formulated by the Government of Himachal Pradesh, which certainly enables an employee to seek transfer from hard area 2 to soft area after his/her having served hard/tribal area for a prescribed period i.e. two winters and three summers.
