The said crime was registered for the offence under section 109(1) ofBNS. 3. The case of the prosecution is that the c/efacfo complainant and the petitioner are close relatives and the petitioner is working in the Indian \_-_-- \ _.I 2 KSR, J Crl.P.No.4946 of 2025 Army. The defacfo complainant is eking out his livelihood by doing real estate business. The elder son of the defacfo complainant is also working in the Indian Army. As the defacfo complainant is earning good money, the petitioner developed grudge against the defacfo complainant. While so, on 03.04.2025, at about 7.00 hrs, the petitioner went to the house of the c/efacfo complainant and bet him with knife on the palm and thigh of the c/efacfo complainant. When the neighbours gathered there, the accused went away. Thereafter, the defacfo complainant went to a government hospital and took treatment. 4. The learned counsel for the petitioner contends that the petitioner is working in the Indian Army and the injuries received by the defacfo complainant are on the right palm and thigh. As such the ingredients of Section 109(1 ) of BNS are not attracted. 5. On the other hand, the learned Assistant Public Prosecutor contended that the defacfo complainant received severe injuries on the right palm and thigh. 6. Be that as it may. As the injuries on the c/efacfo complainant were not on vital parts, this Court is inclined to grant Anticipatory Bail to the petitioner with certain directions: i. The petitioner/accused is directed to surrender before the Station House Officer, Kotabommali Police Station, on or before 05.06.2025. i-_. -JJ C--:,, 3 KSR, J Crl.P-No.4946 of 2025 ii. Upon such surrender, he shall be enlarged on bail on his furnishing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of Station House Officer concerned; iii. After release, the petitioner is directed to co-operate with the Investigating Officer; and lV. The petitioner/accused is directed to appear before the Investigating officer as and when required by the Investigating Officer. 7. Accordingly, the Criminal Petition is allowed.
