Learned counsel for the applicant submits that the first bail and second bail application of the applicant was rejected by this Court on merits in spite of the time being granted to the learned trial Court to expedite and conclude the same and in this case out of 18 prosecution witnesses, statements of 04 witnesses have been
3 recorded including the victim by the trial Court who has not supported the case and further the order-sheet of the trial Court reflects that the statement of the victim’s husband has not yet been recorded and the trial is likely to take some time therefore, he prays for grant of bail to the applicant. 6. Learned Panel Lawyer, appearing for the State/non-applicant opposes the bail application and submits that as the trial has already started and the victim’s statement has already been recorded, statement of the victim’s husband not being recorded cannot be a ground for allowing this bail application. 7. I have heard learned counsel appearing for the parties and perused the case diary. 8. Considering the fact and circumstances of the case that the first and second bail application of the applicant have already been rejected by this Court on merits and in this case, out of 18 prosecution witnesses, 04 witnesses have already been recorded by the trial Court including the victim, as such, the statement of the husband of the victim not being recorded yet cannot be a ground to release the applicant on bail. 9.
