By means of the present application, the applicant has sought following reliefs:- "It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow the present application by directing to the learned Additional Principal Judge, Family Court, II, Bareilly to consolidate the Criminal Misc. Case No. 220 of 2025, filed under section 144(3) B.N.S.S., 2023 and Criminal Misc. Case No. 1576 of 2024, filed under section 379 B.N.S.S., 2023, otherwise the applicant shall suffer irreparable loss and injury. And Further the learned Additional Principal Judge, Family Court, II, Bareilly may be directed to stay the further proceeding of Case No. 220 of 2025, till the disposal of the Criminal Misc. Case No. 1576 of 2024, Nadeem Mian Vs. Farheen Siddiqui under section 379 of B.N.S.S., 2023, Further the learned Additional Principal Judge, Family Court, II, Bareilly may be directed to decide the Criminal Misc. Case No. 1576 of 2024, Nadeem Mian Vs. Farheen Siddiqui" under section 379 of B.N.S.S., 2023, pending before him expeditiously within stipulated period, so that justice may be done." 2. At the outset, Learned counsel for the applicant states that he confines his submissions to the third prayer made and does not wish to press the first two prayers made in the Application U/s 528 BNSS. He further states that he has moved an application under Section 379 BNSS, which has been registered as Criminal Misc. Case No.1576/2024 (Nadeem Mian vs. Farheen Siddiqui) on 18.07.2024 and the same is still pending consideration. He submits that this application was moved for the false assertions made by the opposite party no.2 in the application U/s 125 Versus Counsel for Applicant(s) : Sandeep Kumar Counsel for Opposite Party(s) : G.A. Nadeem Mian .....Applicant(s) State of U.P. and Another .....Opposite Party(s) Cr.P.C. 3. Considering the submissions made by the Learned counsel for the applicant and in view of the order being passed, notices are not being issued to the opposite party No.2. 4. The Additional Principal Judge, Family Court, Court No.II, Bareilly is directed to decide the Misc. Case No.1576/2024 (Nadeem Mian vs. Farheen Siddiqui) expeditiously without granting any unnecessary adjournments. 5. With these directions, this Application is disposed off. October 28, 2025 A.
