Mr. Ram Kumar Sinha, learned advocate appears on behalf of petitioner and submits, his client is allottee. He runs a shop from the allotment. Tender of rent was refused. His client filed this petition to compel the authority to accept the rent. After the filing his client received notice dated 9th October, 2025 asking him to appear, purportedly for being heard. He seeks interference. 3. Dr. D.K. Tiwari, learned advocate Additional Chief Standing Counsel appears on behalf of State. Mr. Shivang, learned advocate holding the brief appears on behalf of respondent nos. 2 to 5 (the Nagar Nigam). He submits, pursuant to order dated 7th August, 2025 made in petitioner's earlier disposed of writ petition (Writ C no. 26410 of 2025), the hearing notice was issued. Petitioner appeared and was heard and inspection is scheduled on 30th October, 2025. He opposes the writ petition. 4. From perusal of stay order dated 7th August, 2025 (supra) it appears, the Nagar Nigam had issued notice/order dated 25th June, 2025 directing petitioner to remove the iron construction Versus Counsel for Petitioner(s) : Ram Kumar Sinha Counsel for Respondent(s) : C.S.C., Raghuvansh Misra Sudhir Kumar .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) raised beyond the allotment. Subsequent notice of hearing was pursuant to direction is said order. In the circumstances, we direct the Nagar Nigam to allow petitioner to put in written defence against said order/notice dated 25th June, 2025 by 31st October, 2025. In event the representation is made, it be duly considered. Otherwise on omission, as hearing has already been given, the Nagar Nigam will pass order. 5. The writ petition is disposed of.
