[2025:RJ-JP:8014] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Vth Bail (Interim) Application No. 5366/2024 Charan Singh Son Of Milkha Singh @ Malkhan Singh, Aged About 19 Years, R/o Khedi, PS Chopanki, District Alwar. (At Present Confined At Central Jail Alwar) ----Accused-Petitioner Versus State Of Rajasthan, through P. P. ----Respondent For Petitioner(s) : None present For Respondent(s) : Mr. Vivek Choudhary, P.P. HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 21/02/2025 None for the petitioner even second round. This fifth criminal miscellaneous bail application has been filed by the petitioner claiming interim bail stating therein that marriage ceremony of his younger sister-Ms. Praveen Kaur is scheduled on 08.05.2024. It is further stated that petitioner’s father is an old man with no other male member to make arrangement for marriage. However, as per the status report dated 06.05.2024 furnished by the Station House Officer, Police Station Chopanki, Police District Bhiwadi, Ms. Praveen Kaur does not happen to be sister of the petitioner rather, daughter of his uncle-Shri Dharambir @ Chamba Singh. In view thereof, this Court, vide order dated 07.05.2024, directed the petitioner to file his affidavit pursuant whereof, the [2025:RJ-JP:8014] (2 of 2) [CRLMB-5366/2024] petitioner has filed an affidavit dated 30.08.2024 wherein, he made following statement in its para 2:- “2- eSa l'kiFk dFku djrk gw fd ijohu dkSj ukrs esa esjh cgu yxrh gS tks fd esjs firk Jh fey[ku flag ¼Milkhan Singh½ mQZ feY[kk flag us esjs pkpk /keZchj dh iq=h ijohu dkSj dks xksn fy;k gqvk gSA ijohu dkSj dk ikyu&iks"k.k] f'k{kk&nh{kk lHkh esjs firk fey[ku flag ¼Milkhan Singh½ mQZ feY[kk flag }kjk gh dh xbZ gS ,oa ijohu dkSj dh 'kknh ¼dU;knku½ Hkh esjs firk fey[ku flag ¼Milkhan Singh½ mQZ feY[kk flag } kjk gh fd;k x;k gSA ” From the aforesaid contents of the affidavit, it is apparent that the petitioner had made self contradictory statement. On the one hand, he says that his father has adopted Ms. Praveen Kaur and in the same breath, he says that she is his sister in “Nata”. Both the facts cannot be true at the same time. In view thereof, The Registrar (Judl.) is directed to instruct the concerned Superintendent of Police to lodge an FIR against the petitioner, get the investigation done under his personal supervision and to ensure filing of the conclusion of the investigation with the jurisdictional Magistrate Court within reasonable time. This fifth criminal miscellaneous bail application is dismissed for non-prosecution with the aforesaid observations. (MAHENDAR KUMAR GOYAL),J Manish/2
