None present for the petitioner. 2. Mr. Sobhit Joshi, Advocate holding brief of Mr. Ashish Joshi, learned counsel for the respondent-Uttarakhand Transport Corporation. 3. Petitioner was employed as Conductor in Uttarakhand Transport Corporation. He suffered from physical disability because of which he was terminated from services, vide order dated 10.01.2023. Petitioner has challenged the said order in this writ petition. 4. Perusal of the writ petition reveals that petitioner was diagnosed with some respiratory disease known as “Pulmonary Disease”. In a Welfare State, State or Instrumentality of State cannot be permitted to terminate services of an employee on account of illness or physical disability. 6. Thus, the ground taken for terminating service of petitioner is unsustainable. 7. Accordingly, the writ petition is allowed. The termination order dated 10.01.2023. Petitioner shall be entitled to all benefits.
