HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 3290 of 2025 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J.
1. This petition, purportedly in public interest, has been filed by the petitioner seeking direction to respondent nos. 2 and 3 to take necessary action against respondent no.4 for using the power not vested in him.
2. Submissions have been made that by notification dated 16.12.2021, powers have been conferred on various authorities based on the amount involved in any work, however, the respondent no.4, despite the fact that he has power for sanctioning work/payment of higher amount, is interfering with the works of lower amount and therefore, direction as prayed for has been sought.
3. Having gone through the averments made in the petition, it is apparent that no public interest is involved in the present petition. We could understand a case where the power, not vested in an authority of a higher amount, is being exercised by that authority.
4. In view thereof, the petition is dismissed. October 29, 2025 AHA/Jyotsana Versus Counsel for Petitioner(s) : Diwakar Tiwari Counsel for Respondent(s) : Seema Agarwal (S.C.)
