Crl.M.P.No.19316 of 2025 in Crl.O.P.No.21128 of 2025 ORDER The present application has been filed in the month of November 2025, seeking modification of the condition imposed by this Court restraining the petitioner from encumbering or alienating the subject property referred to in O.S.No.44 of 2024. It is the submission of the learned counsel for the petitioner that unless the property is permitted to be encumbered, the question of settlement cannot be effected. However, the learned counsel fairly submitted that the parties are presently negotiating for settlement and that the mediation proceedings are pending.
2. In view of the above submission, this Court is of the view that the question of considering the present application does not arise at this stage. Hence, this criminal miscellaneous petition is closed. However, the petitioner is at liberty to move a fresh application for relaxation, if so advised, after the conclusion of the mediation proceedings. 30.03.2026 cda 2/4 https://www.mhc.tn.gov.in/judis
