JUSTICE SOUMITRA SAIKIA ORDER 24.09 .2025 Heard Mr. I. Rafique, learned counsel for the petitioner. Also heard Mr. R. Dhar, learned Addl. Senior Government Advocate for the State respondents. This writ petition has been filed by the petitioner in pursuance to a departmental proceeding being D.P. No. 03/2025. The petitioner was awarded major punishment – “Dismissal from Service” by order dated 26.03.2025. The petitioner thereafter preferred an appeal before the Appellate Authority on 30.04.2025, which according to the petitioner has not been disposed of. Being aggrieved he has filed the present writ petition. When the matter was listed on 13.08.2012, the learned Addl. Senior Government Advocate was permitted to complete his instructions. Today when the matter is called up Mr. R. Dhar, learned Addl. Senior Government Advocate on instructions submits that the appeal filed by the petitioner is still pending and is under consideration by the appellate authority, however, the appeal has not yet been disposed of. Copy of this instruction is placed before the Court, which is kept in the case record. Considering the fact that the Appellate Authority is presently in seisin of Page No.# 3/3 the appeal filed by the petitioner, this Court consider it appropriate to dispose of the writ petition at this stage without issuing notice. The Deputy Inspector General of Police (CID) is directed to dispose of the appeal which has been preferred by the petitioner within a period of 60 days from the date of receipt of certified copy of this order. Needless to say, if any such order that may be passed by the Appellate Authority, a copy thereof shall be served on the writ petitioner. With the above observations this matter stands disposed of.
