1. Proceedings of this matter have been taken through Video Conferencing.
2. Heard Mr. Harshmander Rastogi, learned counsel for the petitioner. Also heard Mr. Vaibhav Shukla, learned counsel, appearing for respondents No.1 to 3 as well as Mr. Sudhanshu Upadhyay, learned counsel holding brief of Mr. Sharad Mishra, learned counsel appearing for respondent No.4.
3. The present petition has been filed by the petitioner with the following prayer:-
“10.1 That this Hon’ble Court may be pleased to set aside the impugned termination order dated 12/08/2024 (Annexure P/1) to the extent that no penalty and forfeiture of performance security deposit is imposed on the petitioner. 10.2 That this Hon’ble Court may be pleased to set aside the e-mail communication dated 04/04/2025 (Annexure P/2) and thereby directing the respondent bank to not to encash the bank guarantee of the Petitioner.
3 10.3 That this Hon’ble Court may be pleased to grant an order of injunction restraining the Respondents herein from either invoking or encashing the bank guarantees dated 13/04/2023 and 15/06/2023 (Annexure P/3 Colly.) deposited by the petitioner. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.”

Learned counsel for the petitioner fairly submits that instant case has become infructuous.

Learned counsel appearing for the respondents have concur the submission of learned counsel for the petitioner.
