RAMA CHANDRA RAO GURRAM The Court made the following: ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “… to issue a Writ order or direction especially one in the nature of Writ of Mandamus declaring the proceedings of the 2nd respondent vide Lr in Rc.No.M2/2/9576/2016 dated 4.6.2016 where under 2nd respondent issued Annexure-III describing Sy.No.1 of an extent of Ac.131.06 cts of Singarayakonda as land belonged to 2 Sri Varahalakshmi Narasimha Swamy vari Temple, Singarayakonda and without verifying the records is illegal, arbitrary and violative of principles of natural justice Arts 19(g) and 300-A of the Constitution of India and consequently set aside the proceedings of the 2nd respondent vide Lr in Rc.No M2/2/9576/2016 dated 4.6.2016 and also the memo of the District Registrar vide M.V.982/2016 dated 9.6.2016 and pass such other order or orders as are deemed fit and proper…” 2. Heard Mr T.V.Jaggi Reddy, learned counsel for the petitioner and the learned Government Pleader for Endowments appearing for Respondent Nos.1 and 2 and Mr Gurram Nageswara Rao, learned counsel appearing for 4th respondent. 3. On hearing, learned counsel for the petitioner reiterated the averments made in the Writ Petition. Whereas, the learned Government Pleader for Endowments appearing for the respondents has submitted a copy of the written instructions furnished by the 2nd respondent to the 6th respondent vide letter No.M2/22828/2016, dated 07.10.2017, wherein the 2nd respondent has instructed the 6th respondent to take necessary steps for deletion of the land in Sy.No.1 to an extent of Ac.131.06 cents of Singarayakonda from Section 22(A) (1) (C) of the Registration Act, 1908. 4. Learned Government Pleader Endowments appearing for the Respondent Nos.1 and 2 opposed for grant of any relief in the writ petition and prayed to dismiss the same. 5. Considering the submissions of learned counsel for the petitioner and the learned Government Pleader for Endowments, the impugned proceedings issued by the 2nd respondent vide Letter in 3 Rc.No.M2/2/9576/2016, dated 04.06.2016 is hereby set aside. The 6th respondent is directed to take necessary steps for deletion of the subject land from Section 22(A) (1) (c) of the Registration Act, 1908 in pursuance of the proceedings issued by the 2nd respondent vide letter No.M2/22828/2016, dated 07.10.2017. 6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
