Ajay Mohan Goel, Judge (Oral) The petitioners are aggrieved by the orders passed by the learned Trial Court as Well as the Appellate Court, in terms whereof, the application filed under Order XXXIX, Rules 1 and 2 of the Civil Procedure Code (hereinafter referred to as ‘CPC’) was dismissed and so was the fate of the Appeal, preferred under Order 43 of the CPC.
2. Having heard learned counsel for the petitioners as well as learned Senior Counsel appearing for the respondent, 1Whether reporters of the local papers may be allowed to see the judgment?
2 2025:HHC:31842 as this Court finds no infirmity in the orders under challenge, this petition is disposed of without interfering with the said
order, but with the observation that whatever construction has been carried or may be carried out by the respondents, shall be at their own risk and peril and the same shall abide by the final
judgment of the Civil Suit and the party shall not claim any equity.
3. The petition is disposed of in above terms. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
