Mr. Arvind Kumar Sharma, Advocate, for the petitioner. Mr. Rahul Verma, Additional AG, for the State. (2) Petitioner was engaged as Seasonal Collection Am in in Roorkee Tehsil of District Haridwar. His engagement was discontinued on account of his conviction by the trial court. His conviction was, however, set aside by this Court in Criminal Appeal No. 94 of 2014. Petitioner thereafter made a representation for his engagement as Seasonal Collection Amin. His representation was rejected on the ground that there is no vacancy available on the post of Seasonal Collection Amin in District Haridwar. (3) Learned Counsel for the petitioner refers to certain documents, which are reply to petitioner’s query under Right to Information Act. Based on those documents, learned Counsel for the petitioner submits that there are still three vacancies in Tehsil Laksar and one vacancy in Tehsil Bhagwanpur, therefore petitioner can very well be engaged on the post of Seasonal Collection Am in. (4) In view of information received by the petitioner under the Right to Information Act, this Court thinks that ends of justice would be met if the District Magistrate is directed to revisit the issue. Writ petition is, accordingly, disposed of with liberty to petitioner to bring the fact of availability of vacancy in Tehsil Laksar and 2025:UHC:10280 Bhagwanpur, in writing, to the notice of District Magistrate, Haridwar. If he does so within two weeks from today, District Magistrate shall revisit the matter and take decision within six weeks thereafter.
