This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 47/2025 (wrongly mentioned as 47 of 2023 in the order sheet) registered at Police Station – New Rajendra Nagar, District - Raipur (C.G.) for the offences punishable under Sections 115(2),351(2) & 69 of of the Bhartiya Nyaya Sanhita, 2023. The prosecution's story is that on 12.03.2025 the complainant lodged an FIR at Police Station New Rajendra Nagar Raipur (C.G.), wherein she has stated that she is resident of Village Karja Bhilai P.S. Jevra Sirsa District Durg and at present she is living in a rented house situated near Amlidih petrol pump and is working as a waiter in the event caterer, during this time she met with the present applicant who was managing the work of event applicant was having self-owned business of event management and was resident of Krishna Puri Amlihdih Raipur. The present applicant started talking with compliant through Instagram from October 2024 and after that he called the compliant to meet him and promised her and assured that he will marry her and will keep her as life partner, and by saying all this he called the compliant for meeting him and took her to a house situated at New Rajendra Nagar and told her that he loves her a lot and will never betray her. The compliant fell in the talks of the present applicant and they both started talking over mobile, then on 16.12.2024 the applicant called the compliant to meet him and for the whole day they both kept roaming in the car then at around 02:00 in the night the applicant took the compliant to Hotel Convivival Sky situated near PWD bridge Mahavir Nagar and by saying that he will marry the compliant established physical relation with her and after this at different places he called the compliant and established physical relation with her. When the compliant asked the applicant to marry her he denied the same and refused to marry and blocked the compliant on his mobile. Compliant tried a lot to meet the applicant but couldn't meet him. On 28.01.2025 they both met again. The compliant then asked the applicant to marry her and the applicant refused to do so and 3 / 4 committed marpit with her and threaten her to defame further threaten her of her family members life. Compliant told about this to her parents also. On the aforesaid the complain of the complaint PS New Rajendra Nagar registered an FIR bearing crime no. 47/2025 for the offence's punishable U/s 69, 115 (2), 351 (2) of the BNS 2023 and took the matter for further investigation. 4. The learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that there is no evidence against the applicant which shows that the applicant has committed the alleged offences., therefore, he prays for grant of anticipatory bail to the present applicant. 5. On the other hand, learned State counsel opposed the anticipatory bail application of the applicant. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, it appears that the victim who is aged about 35 years and the present applicant were in a consensual relationship and they established sexual relationship, thereafter, their relationship could not be materialize, consequently, the present FIR has been lodged by the victim on the ground that the present applicant refused to marry her. Therefore, without further commenting anything on merits, I am inclined to grant anticipatory bail to the applicant. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant –Ranjan Kumar Sahu, on executing a personal bond and one surety in the like sum to the satisfaction of the 4 / 4 arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
