3. The present writ petition has been filed against the order dated 14.5.2025 passed by the Consolidation Officer, Rambagh, District Mirzapur-respondent no.2 in Case No. 237 and its Computerized Case No. 20255416533101312 (Rajnish Ranjan Vs. Ashutosh Ranjan) thereby rejecting the application for interim relief filed by the petitioner. 4. The contention of the learned counsel for the respondent no.3 is that the order dated 14.5.2025 was passed in the proceedings under Section 9A(2) of the U.P. Consolidation of Holdings Act, 1953, which were pending before respondent no.2. It is further stated that the proceedings under Section 9A(2) of the U.P. Consolidation of Holdings Act, 1953 between the parties pending before the respondent no.2 have finally been decided by the respondent no.2 by means of judgment and order dated
11.7.2025.
A copy of the aforesaid order has been placed before this Court by means of Annexure No. SA-1 to the supplementary affidavit dated 30.7.2025 filed on behalf of respondent no.3. 5. In view of the submissions advanced on behalf of respondent no.3, prima facie it appears that the cause of action for filing the present writ petition no longer survives, in light of the final adjudication of the objections under Section 9A(2) of the U.P.C.H. Act, 1953. 6. Let this matter be listed on 6.11.2025 peremptorily."
5. Considering the fact and title objection under Section 9-A (2) of U.P.C.H. Act filed by petitioner has been decided finally and appeal under Section 11 (1) of U.P.C.H. Act filed by petitioner is pending before Settlement Officer of Consolidation, as such, no cause of action survives in this matter. 6. Considering the entire facts and circumstances of the case, the instant writ petition is dismissed as infructuous with liberty to petitioner to press his pending appeal under Section 11 (1) of U.P.C.H. Act in accordance with law. November 6, 2025 Rameez WRIB No. 2384 of 2025 2 (Chandra Kumar Rai,J.) Digitally signed by :- RAMEEZ AHMED High Court of Judicature at Allahabad
