Bisht, Additional Chief Standing Counsel for the State of Uttarakhand / respondent nos. 1 to 3. 3. According to the petitioner, he purchased a grazing permit from one Mr. Mohan Singh in October, 2025, however, the forest authorities are not permitting the petitioner to graze his cattle in the forest area. The relief sought in the writ petition are as follows: - “(i) Issue a writ order or direction in the nature of certiorari quashing and setting aside the impugned grazing permit dated 03.12.2025 (Annexure-4) issued by respondent no.2 in favour of private respondent in respect of Gangikhadak Beat Nos. 1, 2 & 3 and Jaykhan Beat Nos. 4, 5, 6 & 7, being illegal, arbitrary and void. (ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to consider and decide the pending transfer application submitted by the original permit holders in favour of the petitioner, strictly in accordance with law and within a time-bound period. (iii) Issue a writ, order or direction in the nature of mandamus restraining the respondents from permitting any third-party grazing or creation of overlapping rights in respect of the aforesaid forest beats during the subsistence of the existing valid permit. (iv) Issue a writ, order or direction in the nature of mandamus directing the respondents to take necessary action against unauthorized grazing in the concerned beats and to maintain status quo in accordance with law”. 4. Learned State Counsel submits that the grazing permit issued by Forest Department is neither transferable nor heritable. He submits that 2025:UHC:11571-DB the grazing permit issued to Mr. Mohan Singh was expired in 2024. Learned State Counsel further submits that if petitioner has any grievance in the matter, then he could have approached the concerned Divisional Forest Officer. 5. The writ petition is, accordingly, disposed of with liberty to the petitioner to make representation to the Divisional Forest Officer concerned. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within four weeks thereafter.
