HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Case: CCP(S) No. 11/2025 IN WP(C) No. 1640/2024 Mohd. Shafi and Ors. ..... Petitioner(s)/Appellant(s) Through :- Mr. Mehtab Gulzar, Advocate Vs Ashish Ranjan and Anr. .....Respondent(s) Through :- Ms. Parkhi Parihar, Advocate for R-1 CORAM: HON'BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 06.08.2025 01. The instant contempt arises out of the order/judgment dated 19.07.2024 passed by this Court in WP(C) No. 1640/2024 in which the writ petition preferred by the petitioners was admitted to hearing and was disposed of at the threshold by directing the respondents not to dispossess the petitioners from the land under their recorded ownership without adopting due process of law. The instant contempt petition has been preferred by the petitioners in which the petitioners have taken a specific stand that despite the fact that the respondents have been informed about the passing of the judgment mentioned (supra) and the copy also stands served, the respondents/contemnors are sitting over the matter and have verbally conveyed to the petitioners that they will dispossess the petitioners from their land forcibly. Sr. No. 16 2 | P a g e CCP(S) No. 11/2025 IN WP(C) No. 1640/2024 02. The instant contempt petition has been preferred without there being any willful disobedience of the order passed by this Court and merely, that petitioners have been allegedly conveyed verbally by the respondents, will not give a cause for filing the instant contempt petition. 03. Confronted with the maintainability of the instant contempt petition, learned counsel for the petitioners seeks withdrawal of the instant contempt petition. Accordingly, the contempt petition is dismissed as withdrawn. However, respondents are directed to comply with the order/judgment dated 19.07.2024 passed by this Court. 04. It is made clear that dismissal of the instant contempt petition shall not come in the way of the petitioners to re-agitate the cause in case cause of action is accrued or there is any willful disobedience on part of the respondents with regard to the order/judgment dated 19.07.2024 passed by this Court.
