The order dated 08.01.2025 passed by the respondent no.3-Sub Divisional Magistrate, Sadar, Saharanpur, by which fair price shop of the petitioner has been suspended, is under challenge in the present writ petition. 2. It is argued by counsel for the respondents that against the aforesaid order appeal will lie before the Commissioner of division as provided under Clause 13 (1) of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 3. In this view of the matter, without interfering with the order dated 08.01.2025 passed by the respondent no.3, present petition is disposed of finally permitting the petitioner to file an appeal as provided under Clause 13 (1) of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 before the appellate authority within a period of two weeks from today. In case such an appeal is filed by the petitioner within a period as stated above, the authority concerned will decide the same on merit strictly in accordance with law expeditiously and preferably within a period of two months from the date of receipt of certified copy of this order.
