IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.9709 of 2025 Date of Decision: 17.06.2025 _____________________________________________________________________ Archana Kumari ……...Petitioner Versus State of Himachal Pradesh & Anr. …....Respondents Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Narender Singh Thakur, Advocate. For the respondents: Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol & Mr. B.C. Verma, Additional Advocate Generals with Mr. Ravi Chauhan, Deputy Advocate General. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) Petitioner herein, who at present is working as TGT (Medical) at Government Senior Secondary School Dansa, Rampur, District Shimla, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide her pending representation (Annexure P-1), whereby she has prayed for her transfer from present place of posting to District Hamirpur on account of adverse family circumstances. 2. It has been averred in the petition that petitioner will complete three years at present place of posting in the month of August, 2025 and prior to her being posted at Government Senior Secondary School Dansa, Rampur, District Shimla, Himachal Pradesh, she was posted at Government High School Shilli, District Kullu, Himachal Pradesh. Since petitioner’s mother-in-law is bed ridden on account of paralysis and her husband is doing private job in Chandigarh, coupled with the fact that there is none to look after her minor children, petitioner has filed representation to the competent authority to transfer her to District Hamirpur, enabling her to take care of her minor children as well as ailing mother-in-law. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. B.C.Verma, learned Additional Advocate General. Mr. Verma, fairly states that representation (Annexure P-1) filed by the petitioner, if not already decided, shall be decided expeditiously. 4. Consequently, in view of the above, this Court, without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to the respondents to consider and decide the pending representation (Annexure P-1) of the petitioner expeditiously, preferably within a period of three weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders thereafter taking 2 note of adverse family circumstances of the petitioner as well as provision contained in Transfer Policy, which certainly enables an employee to seek transfer/adjustment on account of adverse family circumstances. Pending application(s), if any, stand disposed of. June 17, 2025 (Sandeep Sharma), (sunil) Judge 3
