Sri Vaibhav Shandilya, learned counsel for the applicant and Sri Ashwani Kumar Rai, learned A.G.A. for the State are present. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed by the applicant with a prayer to issue a direction to the Principal Judge Family Court, Mahoba to decide the Execution Case No. 183 of 2019 arising out of Case No. 205 of 2016, under Sections 125 of Cr.P.C. by which learned Magistrate partly allowed the application on 13.02.2019 and awarded Rs. 2,000/- per month to the applicant no. 1 and Rs. 1,500/- to the applicant no. 2. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
