SOMASHEKAR, C.J.) 14.08.2025 [1] Heard Mr. H. Samarjit, learned senior GA for the appellants and so also the learned counsel for the respondent, Mr. SD Singh. [2] Whereas the senior counsel for the respondent in this matter submitting that there is a conditional order dated 16.07.2025 that the appellants shall deposit the award amount at 50% with an accrued interest but till these days, the conditional order has not been complied with and on JOHN TELEN KOM Digitally signed by JOHN TELEN KOM Date: 2025.08.14 16:46:37 +05'30' Page | 2 these premises only, the learned counsel for the respondent is opposing the application for extension of time for compliance of the order dated 16.07.2025. [3] Whereas the learned senior, GA Mr. H. Samarjit for the State of Manipur and whereby pressing for consideration of the application seeking for extension of time for compliance of the conditional order dated 16.07.2025. [4] However, the award has been rendered by the Arbitrator and subsequent to that award, the matter went up to the Hon’ble Supreme Court of India in a proceeding in SLP No. 8399-8402 of 2025 and the same has been disposed of and no further extension has been granted. This forceful submission has been made by the learned counsel appearing for the respondent. However, the proceeding in EP No.1 of 2023 is pending before the Execution court for execution of the award rendered by the arbitrator. [5] Therefore, keeping in view the status in this matter are concerned and also the reasons stated in the extension application, it is deemed appropriate to consider the aforesaid application but required to be imposed further condition that the appellant/State of Manipur shall deposit 75% of the award amount with accrued interest within a period of three weeks from the date of receipt of a copy of this order and if no compliance Page | 3 of the aforesaid conditional order, the Chief Secretary of the State of Manipur shall be present before this Court physically. Accordingly, the proceeding in MC(Arb.A)No.1 of 2025 is disposed of. [6] Consequently, list the remaining proceedings on 04.09.2025. JUDGE CHIEF JUSTICE John Kom
