Learned counsel further submits that till date there is no FSL report available on the record, which fact has also been admitted by the learned A.G.A. for the State. Learned counsel further submits that since there are material contradictions in both the statements of the victim under Sections 180 & 183 B.N.S.S. as well as in absence of any definite opinion given by the doctor regarding her sexual assault, further from her both the statements it appears that victim was a consenting party and the applicant has falsely been implicated in the case. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned.
