Mr. Shailendra Nauriyal, learned counsel for the applicant. 2. Mr. Tumul Nainwal, learned A.G.A. with Mrs. Meenakshi Sharma, learned Brief Holder for the State. 3. Mr. Reituparna Joshi, learned counsel holding brief of Mr. Shivanand Bhatt, learned counsel for the complainant. 4. Present applicant Mohd. Umar alias Sahil, S/ o Mohd. Raheesh Ahmad is praying for bail in relation to FIR dated 19.10.2025, bearing FIR No. 0153 of 2025, registered at P.S. Dalanwala, District Dehradun, wherein the present applicant has been implicated for the offences punishable under Sections 109(1), 121(1), 132 and 324(4) of BNS 2023. 5. Learned counsel for the applicant argued that the applicant is innocent and the case is nothing but it is an accidental case and there is no any such intention. He further submits that applicant has no previous criminal history and if he is granted bail, he will cooperate with the investigation. On the previous date, the State was directed to get the instructions. 6. Today, Mr. Tumul Nainwal, learned A.G.A. on instructions apprise to this Court the applicant has no previous criminal history, however, he submits that the investigation is still going on. 7. After hearing the arguments of the learned counsel for the parties and after perusing the FIR, this Court is of the view that the present applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the applicant “Mohd. Umar alias 2025:UHC:10292 Sahil” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 10. It is made clear that after being released on bail the applicant shall cooperate with the investigation, failing which the prosecution is free to move bail cancellation application.
