Also heard Mr. R.J. Baruah, learned Additional Public Prosecutor for the State. 2. This application under Section 483 of BNSS, 2023 has been Page No.# 2/3 filed by the petitioner, namely, 1. Siba Debnath, who has prayed for bail in connection with Jagiroad P.S Case No. 170/2025 registered under Sections 331(4)/305 of BNS, 2023. 3. The allegations in the ejahar dated 06.07.2025, lodged by Sipra Rani Choudhury Paul is that when she went to Guwahati for medical treatment for some purpose, upon returning she found her house being broken open and some goods stolen. The list of stolen goods is given in the ejahar. 4. The accused person along with other co-accused were arrested during investigation. 5. Case diary has been received. 6. Mr. R.J. Baruah, learned Additional Public Prosecutor for the State submits that from the seizure list, it is not clear as to which material object was seized from whom but the stolen items appear to have been recovered. 7. The learned Additional Public Prosecutor for the State objects to the grant of bail at this stage. 8. It is also revealed from the investigation that the DSLR Camera supposed to be stolen was recovered from one Manoj Kumar Amchi, who has stated that he purchased the said item from the present accused i.e. Siba Debnath. 9. Investigation has not yet been completed. 10. However, considering the length of detention, the recovery as well as the progress of investigation, the accused/petitioner, namely, Siba Debnath is allowed to go on bail of Rs.25,000/- (Rupees Twenty Page No.# 3/3 Five Thousand) only with one surety of like amount subject to the satisfaction of the concerned learned court with following conditions: (i) That the petitioner shall cooperate in the remaining investigation; (ii) That the petitioner shall not indulge in any illegal activities, including any activities of theft etc; (iii) That the petitioner shall not hamper or tamper with any evidence. 11. Violation of bail conditions might entail cancellation of the bail. 12. Return back the case diary. 13. With the above observations, this bail petition stands allowed and stands disposed of.
