M/L 104 19.08.2025 Bpg. ct.no.35 W.P.A.7168 of 2025 With CAN 1 of 2025 Smt. Archana Mal Versus The State of West Bengal & Ors. Mr. Kunal Ganguly Mr. Sudip Kushari. ...for the petitioner. Mr. Sirsanya Bandopadhyay Ms. Tapati Samanta. …for the State-respondents. Mr. Siddhartha Sarkar. …for the respondent no.4. Ms. Pampa Dey (Dhabal) Mr. Biswarup Chatterjee. …for the private respondents nos.5 to 9. Petitioner approached this Court for inaction of the police authorities. Records reflect that subsequently Kotulpur P.S. Case No.172 of 2025 and Kotulpur P.S. Case No.178 of 2025 have been registered for investigation. Petitioner’s main grievance is that she intends to construct a house but has been resisted by the private respondent no.5 to 9. Having considered that the police authorities have taken steps by registration of FIR and the jurisdictional court being seisin of the criminal cases, petitioner, if she is faced with further inconveniences, 2 will approach the jurisdictional court in seisin of the aforesaid criminal cases for redressing her grievances so far as the issues relating to violation of law is concerned. Learned advocate for the State submits that a title suit is pending before the learned Civil Judge (Junior Division), Bishnupur. In view of the directions passed above, I am of the opinion that further pendency of the writ petition is unwarranted. Accordingly, WPA 7168 of 2025 along with CAN 1 of 2025 is disposed of. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
