The present intra-court appeal is directed against the order dated 09.10.2025 whereby learned Single Judge while entertaining the writ petition filed against the order of recovery dated 19.08.2025 has invited counter affidavit from the respondents and has fixed 21.11.2025 for hearing of the writ petition, as a fresh case. 2. As only counter affidavit has been invited and stay application is still pending and a date has been fixed in the case for being taken up as a fresh case, we find no good ground to interfere with the order of learned Single Judge. 3. The appeal is dismissed. It is left open to the appellant to press his stay application on the next date. In case, there is any urgency, he can also move application before learned Single Judge for preponement of the date of hearing of the case.
