Being aggrieved by an order of the Land Tribunal (the Tribunal) by which the Tribunal has conferred occupancy rights in respect of 4 acres in favour of the tenant and it has refused to grant remaining 4 acres 37 guntas, both the land lord as well as the tenant are before this Court by way of these writ petitions. 2. It is the case of the tenant that he was the tenant of the entire land bearing Sy.No.1 measuring 8 acres 37 guntas of Yerekoppa Village in Shivamogga and this was evidenced by the entries in the revenue records since 1969-70, wherein, in the cultivator’s - 5 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 column his name had been entered and the mode of cultivation was also shown as tenant. The tenant therefore contends that the Tribunal could not have restricted his claim only to 4 acres and could not have rejected the application in respect of the remaining extent of 4 acres. 3. The landlord however contends that the land in question was a land, which was donated to a Trust, which is running a School and incidentally the tenant was none other than the brother of the President of the Trust and, therefore, there was no question of any tenancy being created. It is sought to be argued that the Trust was itself getting lands cultivated and, therefore, the Tribunal had erred in conferring occupancy rights in respect of the tenant. 4. It is not in dispute that the total extent of 8 acres 37 guntas in Sy.No.1 was donated to a Trust with a stipulation that the income derived from the property - 6 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 should be utilized for the benefit of poorer students in the School being run by the Trust. 5. It is also not in dispute that the tenant filed an application seeking for conferment of occupancy rights in respect of the entire 8 acres 37 guntas. The RTCs of the relevant year does state clearly that the tenant was in possession of the entire extent of 8 acres 37 guntas. 6. The Tribunal was however taken note of the fact that the Head Master of the School has deposed that the School was aware of the entries in the RTC and yet it had not taken any steps to get the same rectified and, therefore, this by itself indicated that the land in question was tenanted. 7. However, the Tribunal has taken the view that it would be in the interest of the village if the kharab portion of the land of 4 acres 37 guntas is not granted to the tenant and only 4 acres is granted to - 7 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 the tenant. It has held that the 4 acres 37 guntas, by rejecting the claim of the tenant, would essentially facilitate the development of the School and benefit the poorer students. 8. Learned counsel appearing for the landlord contends that the records produced before the Tribunal and also before this Court indicates that the property was being maintained by the Trust and, therefore, there was no question of tenancy more so when the tenant was none other than the brother of the President of the Trust. 9. Strong reliance is sought to be placed on the minutes recorded by the Trust of the year 1967 and 1969. The minutes recorded by the Trust would itself indicate that the land was being cultivated and the Trust was required to be given a share of the crop. In fact, in the minutes of the year 1969, there is a clear reference to the extent of rent that was required to be paid. 11. This fact would thereby clearly establish that the land in question was a tenanted land and, as a consequence, had stood vested in estate free from all encumbrances. This fact is also established by the entry in the RTC, in which the name of the tenant has been reflected, and the mode of cultivation was shown as tenanted. 12. The argument that the tenant happens to be the brother of the President of the Trust and, therefore, there can be no tenancy cannot really be accepted since it is admittedly the case of both the parties that the land belonged to the Trust and, therefore, the - 11 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 mere fact that the President of the Trust and the applicant were brothers, that would not indicate that the brother had tenanted the land to another brother. 13. The title of the property being vested in the Trust, if the President of the Trust had entrusted the task of cultivation to his brother, their relationship per se would not determine the character of this transaction. The minutes which are produced by the Trust by themselves establish that the land was tenanted and the Trust was gaining a crop share and also rents. 14. It can also be seen from the minutes of the Trust that the President of the Trust was not the only person in charge of the Trust and the Trust was governed by several Trustees. 15. It will therefore be incorrect to accept the contention that one brother had tenanted the land to another. - 12 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 Obviously, the Trust being governed by several Trustees, they had taken a collective decision regarding the tenancy and, therefore, the relationship of the President with the tenant would really be of no significant consequence. 16. In that view of the matter, the finding of the Tribunal that the land in question was tenanted and the tenant was entitled to be conferred with the occupancy rights cannot be found fault with. 17. This would therefore lead to the logical conclusion that the tenant would be entitled to be conferred with the occupancy rights in respect of the entire land for which he had made a claim i.e., for 8 acres 37 guntas. 18. However, the Tribunal has taken the view that interest of justice would be served if only 4 acres was conferred in favour of the tenant and the kharab portion of 4 acres 37 guntas should not be granted - 13 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 as this would enable it to be utilized for the development of the School, which would ultimately benefit the poorer students of the School. 19. In my view, if the Tribunal was recorded a finding that the Trust should be permitted to utilize the kharab portion of 4 acres 37 guntas for the purpose of the School, this finding cannot be interfered with. It is to be stated here that a kharab portion is essentially an uncultivable portion, though it is a part of a cultivable portion in a survey number. 20. If the Tribunal which comprises of four local members are of the view that the interest of the School will have to be protected and, at the same time, the tenant should also be conferred with the occupancy rights, such an order does not call for any interference. 21. In that view of the matter, in my view, there is no merit in either of the writ petition filed by the land - 14 - NC: 2025:KHC:17177 WP No. 40839 of 2017 C/W WP No. 46654 of 2017 lord or by the tenant. Both the writ petitions are therefore dismissed. 22. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of.
