Heard Sri Parvez Alam, learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. The present petition has been filed by the petitioner seeking a direction to respondent no.2 to bring the recovery certificate dated 10.03.1999 to its logical conclusion. 3. It is contended by the counsel for the petitioner that termination of service of the petitioner by respondent no.6 was challenged under the reference made before the Prescribed Authority, Labour Court, which was adjudicated by the award dated 24.03.1998, passed in Adjudication Case No.120 of 1998. The said award was challenged by the respondent no.6 in Writ Petition No.43768 of 1998, which was dismissed as having become infructuous by the order of this Court dated 26.04.2011 and has attained finality. Respondent no.4 sent a reminder dated 24.07.2024 to the respondent no.2 to proceed with the recovery citation dated 10.03.1999 by realizing amount under the award as arrears of land revenue from respondent no.6. It is further contended that the petitioner workman is out of employment since May, 1995 and is running from pillar to post for implementation of the award dated 24.03.1998. 4. In my opinion, the recovery certificate issued by the respondent no.4 in proceedings under Section 6H(1) of the U.P. Industrial Disputes Act, 1947 should be brought to its logical end at the earliest. 5. In view of the aforesaid, the present petition is disposed of directing Versus Counsel for Petitioner(s) : Parvez Alam Counsel for Respondent(s) : C.S.C. Santsaran Singh .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) the respondent no.2 to take appropriate action for recovery of the amount as contained in the recovery certificate, dated 10.03.1999, in accordance with law, preferably within a period of two months from the date of presentation of a certified copy of this order, if there is no other legal impediment.
