HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 4142 of 2022 Court No. - 37 HON'BLE DINESH PATHAK, J. 1. Instant contempt application has been filed alleging the wilful disobedience of the order dated 24.9.2018 passed by this Court in Public Interest Litigation (PIL) No. 4428 of 2018. 2. Learned Standing Counsel has submitted that the proceeding under Section 26 of the UP Revenue Code, 2006 has been initiated and decided by the authority concerned in compliance of the order dated 24.9.2018 passed by this Court; therefore, no cause of action survives to maintain the instant contempt application. 3. Learned counsel for the applicant has tried to challenge the legality and validity of the order passed by the authority concerned under Section 26 of the UP Revenue Code, 2006. 4. In my considered opinion, the present applicant has an appropriate remedy to approach before the authority concerned to assail the order passed under Section 26 of the UP Revenue Code, 2006. This contempt court has no jurisdiction to examine the legality and authority of the order passed under Section 26 of the UP Revenue Code, 2006. 5. As such, instant contempt application is dismissed as infructuous. October 29, 2025 vinay Versus Counsel for Applicant(s) : Vivek Singh Counsel for Opposite Party(s) : (Dinesh Pathak,J.)
