HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 15758 of 2025 Court No. - 32 HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri G.K. Singh, learned Senior Counsel assisted by Sri H.P. Sahi, Sri Ashok Mehta, learned Additional Advocate General assisted by Sri P.K. Shahi, learned Additional Chief Standing Counsel for State- respondent nos.1 to 6 and Sri Amit Negi, learned counsel for respondent no.7. 2. Matter before this Court is a dispute of financial approval of appointment of the petitioners in the respondent University namely, Sam Higginbotton University of Agriculture, Technology and Sciences, Prayagaraj along with financial approval of other appointees. It appears that the matter is still under consideration with the State Government. Meanwhile, by the impugned order dated 22.09.2025 passed by Joint Secretarty, Agriculture Education and Research Department, U.P. Government, whereby grant-in-aid to the respondent University is stopped until further orders. 3. Sri G.K. Singh, learned Senior Counsel appearing on behalf of the petitioners submits that without giving any specific finding in regard nature of appointment of the petitioners, their salary have been withheld. He further submits that only on basis of pending enquiry the respondent authorities have stopped grant-in-aid to the respondent University, which is illegal and not justified at all. 4. Per contra, Sri Ashok Mehta, learned Additional Advocate General submits that the State is conscious about the grievances of the petitioners, Versus Counsel for Petitioner(s) : Hritudhwaj Pratap Sahi, Sankalp Narain Counsel for Respondent(s) : Amit Negi, C.S.C. Professor (Dr.) Vikram Singh And 9 Others .....Petitioner(s) State Of U.P. And 6 Others .....Respondent(s)
and therefore, for expediting the procedure, they have constituted a Four Members Committee by an Office Memo dated 27.10.2025 and within a very shot period of one month, a report would be submitted and its legal consequence would follow. 5. Sri Amit Negi, learned counsel for respondent no.7-University submits that in pursuance of the impugned order, all relevant documents have already been provided to the State authorities. He further submits that to ensure expeditious conclusion of the enquiry, a fresh copy of all relevant documents will be provided within three days at the Office of the concerned respondent. 6.
I have considered the above submissions and considering that any comment of the Court at this stage regarding nature of appointment of the petitioners and others would cause prejudice to either party, therefore, this Court is not entering into merits of the case. However, so far as the grievance of the petitioners that there salary has been stopped due to stopping of grant-in-aid to the respondent University, this Court directs that in case the respondent University cooperates and provides all relevant documents to the concerned respondent within three days, then the said Four Members Committee shall conclude the enquiry and submit its report within 15 days from the date of submission of the documents. It is further made clear that if necessary representative of the respondent University may be call upon by the concerned respondent to place their case. In case, the concerned respondent fails to take consequential decision on basis of enquiry report within 15 days, the impugned order shall be kept in abeyance, subject to a decision to be taken on basis of report. 7. The writ petition is disposed of with aforesaid observations and directions. October 28, 2025 Manish Himwan WRIA No. 15758 of 2025 2 (Saurabh Shyam Shamshery,J.)
