JUSTICE SHAMIMA JAHAN ORDER 16.10.2025 Heard Mr. P.K. Kalita, learned counsel appearing for the petitioners. Also heard Mr. B. Sharma, learned Addl. Public Prosecutor appearing for the State. By this application, the petitioners have prayed for pre arrest bail in connection with Khetri P.S Case No. 56/2025 registered under Section 316(2)/318(4) of the BNS, 2023 read with Section 21(1)(2)(3) of Banning of Unregulated Deposit Schemes Act, 2019. The FIR dated 22.06.2025 reflects that the society namely Unnati Trading Cooperative Society Ltd. was operating in the Khetri area and that the informant i.e., the Sub Inspector of Police on information that the society was collecting huge funds from the public in violation of the act had lodged the FIR. The informant further stated that the society was supposed to collect funds only to help its members but it was found that the same has been collecting huge funds under the Banning of Unregulated Deposits Scheme Act, 2019. Vide order dated 11.08.2025, the petitioners were allowed interim protection with the condition that they would cooperate with the investigation and should Page No.# 3/3 appear before the Investigating Officer whenever they are called for and in pursuant to the said direction, the petitioners had appeared before the Investigating officer and got their statements recorded which is reflected in the Case Diary. It is as such seen that the petitioners are corporating with the investigation and accordingly, the interim order dated 11.08.2025 may be made absolute with the further direction that they may comply with the conditions mentioned therein without fail.
