A case has been registered against the petitioner and others for the 2. offence punishable u/Sec.109(1) of the B.N.S. Heard learned counsel for the petitioner and the learned Assistant 3. Public Prosecutor representing the respondent/State. 2 Case of the prosecution, in brief, is that, one Shaik Mahaboob (defacto complainant) reported that he has been working as Civil Incharge in Surya Mitra Exim Private Limited, for 8 months and he got married and at present he is living in Palakollu along with his family. He has been acquainted with U.Rohini of Nidadavolu for past 15 years, her parents also knew about this fact. Since one month, U.Rohini has stopped talking to him. It is alleged that since then she has been instigating her brother against him. On 22.4.2025 at 11.00 pm, he went to Rohini’s house and asked her why she was not taking to him, then she cursed him and yelled at him to go away and he left there. It is alleged that on the same day, when he was drinking at Gayatri Urvasi Bar & Restaurant, then the petitioner came there and said he had something to talk to him. 'Then he hit him on the backside of the head with a beer bottle that was available there with an intention to kill him. While he running away in fear for life, then the petitioner chased him and said, I will kill you today and again beat him on the head and also tried to stab him in the stomach and tried to kill him. Then, fearing for life, escaped and went to Police Station on his bike where the police took him to the Hospital. Heard. Perused the record. Learned counsel for the petitioner submits that Section 109 of the BNS is not applicable to the facts of the case and hence prayed to release the petitioner on anticipatory bail. 4. was 5. 6. 3 r Learned Assistant Public Prosecutor submits that the investigation is at crucial stage in this case and prays to dismiss the criminal petition. A perusal of the record and the contents of the report shows that specific accusation has been made by the defacto complainant Shaik Mahaboob that the petitioner attacked him with a bear bottle and bet with bear bottle on his head. 7. 8. 9. Considering the submissions of the learned counsel for the respective parties and the severity of the injury i.e. injury on head, this Court is not inclined to grant anticipatory bail to the petitioner.
