The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 07.09.2025 registered as Case Crime No. 0283 of 2025, under section 137 (2) of B.N.S., Police Station Belipar, District Gorakhpur and for a direction to the respondents not to arrest the petitioners in pursuance of impugned First Information Report. 2. Taking into consideration, the averments made by the learned counsel for the petitioner, in particular, the fact that both the petitioners are major as per their High School Certificates and averments made by the prosecutrix in her statement recorded under Section 183 BNSS and also considering the ratio of Hon'ble Apex Court in the case of Gian Singh v. Therefore, in view of the above, this petition succeeds and is allowed. 7.
