Heard Sri Akhilesh Chandra Shukla, learned counsel for the revisionist; Sri Ishwar Chandra Tyagi, learned counsel for the opposite party no. 2 and learned A.G.A for the State-respondent no. 1 and perused the trial court record. 2. This criminal revision has been filed praying for setting aside set-aside the order dated 06.12.2024 passed by Special Judge (S.C/S.T.Act) Meerut in Misc case No.968 of 2022 under Juvenile Justice (Care and Protection Act) 2015 arising from Crime No.186 of 2014, under section 147,148,354,323,504 IPC and section 3(1) (10), 3(1) (11) of Scheduled Castes and Scheduled Tribes Atrocities) Act, 1989, P.S. Mawana, District- Meerut. 3. An application was made before the Special Judge by the father of the revisionist that the date of birth of the revisionist is 21.07.1999 and therefore on the date of incident dated 17.03.2014, he was aged about 15 years, 7 months and 27 days and hence he may be declared juvenile. In support of his application, he filed his affidavit, photostat copies of Identity Card, Scholar Register, Transfer Certificate and Marks Sheet of revisionist of High School Examination of 2014. 4. The complainant filed objection to the aforesaid Application and stated that the documents filed by the father of the revisionist are fabricated. 5. Head Master of Mamraj Memorial Junior High School, Seena, Mawana, Meerut filed Certificate dated 04.11.2015 with the objection that the revisionist was never student of his School in Class-6, 7 and 8, there is no such record in his School and the Transfer Certificate dated 05.12.2014 was never issued by him. In the photocopy of the High School Marks Sheet, the name of the father of accused Vikrant Pahal is mentioned as Shiv Kumar Sharma. The High School Marks Sheet is fabricated since the accused is "Jat"and his father cannot be "Sharma". 6. It appears that on the basis of the statement of Head Master of Mamraj Memorial Junior High School, the U.P. Secondary Education Board Regional Office, Meerut Versus Counsel for Revisionist(s) : Akhilesh Chandra Shukla Counsel for Opposite Party(s) : Ishwar Chandra Tyagi, G.A. Vikrant Pahal .....Revisionist(s) State Of U.P. And Another .....Opposite Party(s) constituted a Committee for examining the validity of the High School Certificate of the revisionist and not finding it to be genuine cancelled the same in its meeting dated 03.11.2017. However, in the criminal case lodged against the revisionist regarding fabrication of High School Marks Sheet/Certificate, final report was submitted by the Police on the basisof the statement of the subsequent HeadMaster of the School, but the cancellation of High School Certificate and Marks Sheet was not reversed. 7. In view of the cancellation of the High School Certificate and Marks Sheet of the revisionist, the Special Judge rejected the claim of the revisionist for declaring him juvenile on the date of incident on the basis of High School certificate/marks sheet. There is also nothing on record which may prove that any application was made before the U.P. Higher Secondary Board to reverse the order of its committee dated 03.11.2017, therefore, the order passed by the Special Judge is justified and calls for no interference by this Court. 8.
