Heard Sri Hinchh Lal Pandey, learned counsel for the petitioner and learned Standing Counsel for the respondents. 2. The petitioner has preferred the present petition with the following prayers:- (A) issue a writ, order or direction in the nature of mandamus commanding & directing the respondent authorities to provide benefit of Pradhanmantri Kisan Samman Nidhi to the petitioner, so that justice may be done. (B) issue a writ, order or direction in the nature of mandamus commanding & directing the concerned authorities to make implementation with the order/letter по.-1856/ Р. M.KISAN/2020-21 dated: 04.03.2021 issued by respondent no.- 02/Deputy Agriculture Director, District : Firozabad vide (Annexure-06 to the writ petition), so; that justice may be done. 3. Vide order dated 01.11.2021, learned Standing Counsel was granted three weeks time to file counter affidavit but till date no counter affidavit has been filed. 4. In view of the prayer made in the petition and with the consent of learned counsel for the parties, the present petition is being heard and decided without waiting for counter affidavit at the admission stage itself. 5. Facts in brief as contained in the writ petition are that the petitioner is small tenure holder and having three gatas being Gata No. 377 area Versus Counsel for Petitioner(s) : Hinchh Lal Pandey Counsel for Respondent(s) : C.S.C. Nirvikar .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) 0.4170 hectare, Gata No. 410Mi. area 0.0570 hectare and Gata No. 515 area 0.3930 hectare total area 0.8670 hectare situated at Village Bamai, Tehsil: Sirsaganj, District: Firozabad and the petitioner is also account holder of Savings Bank Account No.-34491553247, CIF No.- 85501707654 of Branch Sirsaganj of State Bank of India at Firozabad. A scheme namely "Pradhanmantri Kisan Samman Nidhi" has been launched by the Government. The petitioner being eligible person, filled up prescribed form and submitted the same before the concerned department but due to some mistake of official of department, the form of petitioner has been insert in illegible persons. When the petitioner came to know regarding this, the petitioner approached with concerned authority, then the concerned authority directed to the petitioner to submits the form again before the office concerned. Thereafter in compliance of direction, the petitioner again filled up a fresh form and submitted the same. After filing fresh from, the petitioner submitted an application dated 08.06.2020 before respondent no.-02/Deputy Agriculture Director, District: Firozabad for amendment in documents and provide benefit of Pradhanmantri Kisan Samman Nidhi to the petitioner, copy of the aforesaid application is appended as Annexure No.3 to the writ petition.When no action has been taken in the matter, the petitioner again moved another application before the respondent no.-02/Deputy Agriculture Director, District: Firozabad on 18.02.2021 repeated the same grievances and official of respondent no.-02 again given its receiving over the application on 18.02.2021. After considering the entire documents which has been produced by the petitioner and after completing entire formalities, the respondent no.-02/Deputy Agriculture Director, District: Firozabad wrote letter dated 04.03.2021 to the respondent No.3/Joint Agriculture Director (Statistics)/Nodal Officer P.M. Kisan U.P .Krishi Bhawan Lucknow to make necessary correction in the Form and consider the claim of the petitioner for grant of benefit under Pradhanmantri Kisan Samman Nidhi. 6. It is argued by learned counsel for the petitioner that considerable time has been lapsed but till date no final decision has been taken in the matter. 7. On the other hand, it is argued by Standing Counsel that respondent No.3 will take a decision in the matter expeditiously. WRIC No. 22319 of 2021 2 8. In the facts and circumstances of the case and without going into the merits of the case, the present petition is disposed of directing the respondent No.3/Joint Agriculture Director (Statistics)/Nodal Officer P.M. Kisan U.P .Krishi Bhawan Lucknow to take a decision in the matter pursuant to the letter dated 04.03.2021 written by the respondent No.2 most expeditiously and preferably within a period of six weeks from the date of production of certified copy of this order. 9.
