(Oral) Petitioner herein, after having completed B.Sc.(Chemistry) from Chaudhary Sarwan Kumar Himachal Pradesh Krishi Vishvavidyalaya (in short “CSKHPKV”) and M.Sc. (Chemistry) from Himachal Pradesh University with B.Ed., also passed Teacher Eligibility Test (TET). Pursuant to advertisement issued by respondent 2025:HHC:25750-DB - 2 - No.3 vide No. 36-1/2020, dated 2.3.2020, whereby 144 posts of Trained Graduate Teacher (Non-Medical) on contract basis came to be advertised, petitioner applied for the same. Selection process consisted of written test of 85 marks and evaluation of documents for 15 marks, total marks being 100. Petitioner applied under General (Unreserved) category vide application No. 2861050. Written examination was conducted on 30.11.2020, wherein petitioner scored 52 marks. Result of written examination was declared on 24.3.2021, whereafter, evaluation was held on 1.7.2021. During evaluation, petitioner submitted B.Ed. certificate, landless certificate, non-employment certificate and NSS certificate. Though on account of above certificates, save and except NSS certificate, petitioner came to be awarded 3.78 marks, as a result thereof, total tally of marks of the petitioner came to be shown as 55.78 marks. Final result on the basis of written examination as well as evaluation of documents was declared on 16.11.2021, wherein petitioner failed to qualify however, she was able to secure 1st place in the waiting panel list (Annexure P- 6) with total tally of marks as 55.78. Since cut off marks for general (Unreserved) category was 55.79 marks, petitioner was denied appointment. Precisely, the grouse of the petitioner is that she has been wrongly not awarded 01 mark for NSS certificate. 2. Feeling aggrieved, the petitioner has preferred present petition for issuance of following writs: 2025:HHC:25750-DB - 3 - “i)That the respondent No.3 may kindly be directed to provide 1 marks of NSS Certificate to the petitioner and thereafter re-draw the select list of the candidates for the post of TGT(NM) on contract basis against General (UN) category and recommend the name of the petitioner for appointment. ii)That the respondent No. 1 and 2 may kindly be directed to give the appointment to the petitioner for the post of TGT(NM) on contract basis from the date when the person below in the merit are appointed with all consequential benefits. iii)That the appointment of respondent No.4 and 5 may kindly be quashed and set aside.” 3. I have heard the learned counsel for the parties and gone through the record. 4. Controversy in the case at hand specifically revolves around NSS certificate (Annexure P-4), which has been issued by CSKHPKV on 3.1.2014, signed by Programme Officer (NSS), Programme Coordinator (NSS) and Dean, certifying therein that petitioner (Shefali Sharma) has attended the NSS Annual Special Camp organized by CSK HPKV at Badehar from 28.12.2013 to 3.01.2014 i.e. 07 days. Said certificate qua the petitioner has been issued in the following format: “CSK Himachal Pradesh Krishi Vishvavidyalaya, Palampur (H.P.) NSS symbol National Service Scheme Certificate N.S.S. Annual Special Camp Certified that Shefali Sharma, S-2011-04-061 son /daughter of Shri Ravinder Sharma, of College of Basic Sciences attended the 2025:HHC:25750-DB - 4 - NSS Annual Special Camp organized by CSK HPKV at Badehar from 28.12.2013 to 3.01.2014. He/She completed the camp with credit. Place: Palampur Dated: 3.1.2014 sd/- sd/- sd/- Programme Officer Programme Dean (NSS) Coordinator (NSS)” 5. Clause 13. Eligibility Conditions (v) provides as under: “The eligibility of candidate(s) called for the evaluation of 15 marks will be determined on the basis of original documents produced at the time of evaluation of 15 marks and the Commission will not be responsible if the candidature of any candidate is rejected at the stage or at the time of verification by the Appointing Authority. As such, admission to the Written Screening Test/ Examination/evaluation of 15 marks shall be purely provisional.” Part-II (Evaluation of 15 marks) under Item No. 6 provides as under: 6. NSS (atleast one year), certificate holders in NCC/The Bharat Scout and guide, Medal winner in National level sports competitions 1 (one) Concerned Head of Institution. Certificate of medal winners will be issued by the concerned District Youth Services and Sports Officer/ Head of Institution 6. As per item No. 6 of Part-II Evaluation, a candidate desirous of getting one mark should possess NSS certificate (NSS certificate of one year) issued by concerned head of the institution. Admittedly, in the case at hand, NSS certificate, which came to be made available by the petitioner during evaluation of document (Annexure P-4) though has been issued by CSKHPKV on 3.1.2014 duly signed by Programme Officer (NSS), Programme Coordinator (NSS) and Dean, but same suggests that petitioner attended the NSS Annual 2025:HHC:25750-DB - 5 - Special Camp organized by CSK HPKV at Badehar from 28.12.2013 to 3.01.2014 i.e. 07 days. 7. Though Mr. Shrawan Dogra, learned Senior counsel appearing for the petitioner(s) duly assisted by Mr. Sanjeev Suri, Advocate, vehemently argued that at the time of interview/evaluation of documents, petitioner possessed required NSS certificate of one year, but since she was not provided ample opportunity to produce the same, she could not make it available on the date of evaluation. While referring to CMP No. 14508 of 2021, wherein permission was sought to place on record certificate dated 11.1.2021, issued by the Student Welfare Officer, CSKHPKV, Palampur, Mr. Dogra, argued that petitioner successfully completed three years of NSS as per Course Curriculum from 2011-12 to 2013-14 Session at CSKHPKV, Palampur, if it is so, she was required to be awarded 1 mark for NSS certificate. Mr. Dogra, submitted that admittedly, afore certificate was not produced at the time of evaluation, but by now it is well settled that in case requisite document was in possession of candidate at the time of interview/evaluation, but he/she failed to produce the same for some unavoidable circumstances, authority responsible for conducting selection process can take note of same subsequently. However, in the case at hand, despite petitioner’s having made afore certificates available, she was not granted one mark, as a result thereof, she failed 2025:HHC:25750-DB - 6 - to secure place in merit list. To support aforesaid contention of him, Mr. Dogra, placed reliance upon following judgments:  Charles K. Skaria vs. C. Mathew (Dr), (1980) 2 SCC 752 (Para 20-22)  Seema Kumari Sharma vs. State of Himachal Pradesh, (1988) 9 SCC 128 (Para 3-4)  Dolly Chhanda vs. Chairman, JEE, (2005) 9 SCC 779 (Para 7-10)  Food Corpn. Of India vs. Rimjhim, (2019) 5 SCC 793 (Para 8-9, 13-14)  Amit Kumar vs. Himachal Pradesh State Electricity Board Ltd. and ors., CWP no. 4922 of 2022 (Para 20-24) 8. From the aforesaid exposition of law it is clear that what is essential is the possession of certificate before the given date and what is ancillary is the safe mode of proof of the qualification. The law does not insist on any rigid form of proof so long as the candidate can establish that she/he was in possession of the qualification within the prescribed time. 9. While making this Court peruse reply filed by respondents No. 1 and 2, Mr. B.C. Verma, learned Additional Advocate General vehemently argued that though advertisement, if perused in its entirety, nowhere suggests that there was requirement, if any, for Rajya Chayan Ayog, to provide opportunity to candidate to make good the deficiency , if any, of documents produced at the time of evaluation of documents, but yet petitioner including other incumbents was given ample opportunity to submit the certificates/documents at the time of screening test and interview and even thereafter, specified period of 2025:HHC:25750-DB - 7 - time was granted to the candidate, who participated in the selection process to submit all relevant documents, which would have been taken into account for the purpose of selection. He submitted that since petitioner failed to produce relevant documents within the stipulated time, no benefit of the same can be asked for at subsequent stage. While referring to paras No. 6 and 7 of reply filed by respondent No.3, learned Additional Advocate General argued that petitioner and respondent No.3 had participated in evaluation of documents on 01.07.2021, but on same day, petitioner could not procure/produce the NSS certificate. He submitted that petitioner had come present with the NSS certificate showing her participation in the annual special camp for duration of 7 days only organized by CSKHPKV, whereas the condition laid down as per Annexure P-2 Part-II (evaluation of 15 marks), petitioner herein was required to produce NSS certificate of at least one year. He submitted that as per evaluation of 15 marks, candidate possessing at least one year NSS certificate could have been given benefit of one mark. He further submitted that as per the guidelines of NSS and the documents annexed in the petition, NSS Certificate is being the integral part of essential qualification prescribed for the post, for which, the petitioner has already been given 1.78 marks out of 2.5 marks of B.Sc. Basic Science Degree Program, for which, the petitioner has already been awarded weightage of NSS marks, as such, there was otherwise no 2025:HHC:25750-DB - 8 - occasion to award one additional mark for her possessing certificate showing that she had participated in NSS Annual Special Camp organized by CSK HPKV at Badehar from 28.12.2013 to 3.01.2014 i.e. 07 days. He submitted that since NSS marks had already been added in the first semester of the basic science i.e. in the year 2011-12, same could not have been given again on the basis of NSS certificate. 10. While referring to para-8 of reply, learned counsel for respondent No.3 referred to National Service Scheme Manual NSS (Revised), wherein it has been stated as under: “National service scheme manual NSS (revised) NSS volunteer who has completed 240 hours of regular activities in the period of two years and attend one annual camp will be issued an NSS certificate by the respective university. In case a volunteer does not fulfill the above condition and has to miss the university certificate, the college authority may issue a certificate to the NSS volunteer. Then a model certificate to be issued to the NSS volunteer is given at Annexure-IX of the above said manual.” 11. Relevant clause 3 of manual and standard format of NSS Certificate is reproduced here in below: “3.Certificate NSS volunteer who has completed 240 hours of regular activities in the period of 2 years and attended one annual special camp, will be issued an NSS certificate by the respective university. In case, a volunteer does no fulfill the above condition and has to miss the university certificate, the college authorities may issue a certificate to the NSS volunteer. A Model certificate to be issued to the NSS volunteer is given at Annexure-IX… Notes on significant experience /activities ANNEXURE-IX 2025:HHC:25750-DB - 9 - NAME OF THE UNIVERSITY NATIONAL SERVICE SCHEME (NSS SYMBOL) This is to certify that Shri /Kum./Smt. ………………………. Son/daughter/ Wife of ……………………….. Class …………….. of …………. College has completed a period of two years as NSS volunteer from ………….. and has done satisfactory work. He/she has also attended NSS Camp/Camps from ……….. to …………… and from …………….. to ……….. held under Scheme)’ Vice-Chancellor Programme Coordinator Principal NSS Dated _________” ANNEXURE-IX NAME OF THE UNIVERSITY NATIONAL SERVICE SCHEME (NSS SSYMBOL) This is to certify that Shri /Kum./Smt. ………………………. Son/daughter/ Wife of ……………………….. Class …………….. of …………. College has completed a period of two years as NSS volunteer from ………….. and has done satisfactory work. He/she has also attended NSS Camp/Camps from ……….. to …………… and from …………….. to ……….. held under Scheme)’ Vice-Chancellor Programme Coordinator Principal NSS Dated _________” 12. Careful perusal of pleadings adduced on record by the petitioner as well as submissions made by learned senior counsel representing the petitioner reveals that petitioner has two fold 2025:HHC:25750-DB - 10 - arguments/submissions; first, that B.Sc. course is an integrated course, which contains NSS activity which she has attended throughout the course i.e. three years; and second, she has produced the requisite certificate, as per condition of the advertisement, as such, she is entitled to 01 mark for NSS certificate. 13. At the cost of repetition, petitioner has placed on record certificate dated 11.1.2021 issued by the Students Welfare Officer, CSK HPKV Palampur, which was inadvertently not annexed with the petition. Certificate is reproduced herein below: “CSK Himachal Pradesh Krishi Vishvavidyalaya, Palampur (H.P.) Students Welfare Organization No.QSD.8-4/NSS/SWO/CSKHPKV/-4163 Dated, Palampur, the: -11/01/2021 To whom it may concern It is to certify that Miss Shefali Sharma, Admission No.(S- 2011-04-061) D/O SH. Ravinder Sharma, College of Basic Science has successfully completed three years of NSS as per the course curriculum from 2011-12 to 2013-14 session at CSKHPKV, Palampur. Sd/- Students Welfare officer CSK HPKV Palampur” 14. Besides above, petitioner by way of filing another application i.e. CMP No. 10402 of 2025, placed on record application dated 18.3.2025 and clarification issued pursuant thereto by the Student Welfare Officer, CSK HPKV, Palampur (Annexure A-2, page 287). Annexure A-2 is reproduced herein-below: 2025:HHC:25750-DB - 11 - “To Ms. Shefali Sharma Admission No.S-2011-04-061 Subject: Seeking clarification regarding authenticity of NSS Certificate already issued. This has reference to your application dated 18.03.2025 regarding the subject cited above. In this context, this is to inform you that this office sought clarification regarding authenticity of NSS Certificate from Dean, College of Basic Sciences, CSKHPKV, Palampur vide this office leter No.8-4/NSS/SWO/CSKHPKV/2025-/-1830 dated 19.03.2025. The Dean, College of Basic Sciences vide letter No.QSD.PF-S-2011-03-061/COBS/CSKHPKV/Acad-6560 dated 21.03.2025 clarified that the concern student (Ms. Shefali Sharma, Admission No.S-2011-04-061) has successfully completed three years attendance of NSS from 2011-12 to 2013-14 session alongwith seven days NSS annual Special Camp attended w.e.f. 28.12.2013 to 03.01.2014. This office also took up the matter with the Registrar, CSKHPKV, Palampur vide this office letter No.8-4/NSS/SWO/CSKHPKV/-1831 dated 19.03.2025 to seek further clarification in this regard. In response to our office letter, the Registrar, CSKHPKV, Palampur, vide letter No.QSD.PF.S-2011-04-061/CSKHPKV/Acad-14010 dated 25.03.2025, informed that no marks are awarded on the DMC’s of the students and only ‘S’ /’US’ grade is awarded. The NSS is non-credit course and its marks are not warded like other courses and the NSS/NCC is a compulsory course for the award of degree as per Academic Regulations of the University.” 15. While referring to afore documents, Mr. Dogra, attempted to argue that no separate NSS certificate is issued to any of the participants and no marks have been awarded in the degree as has 2025:HHC:25750-DB - 12 - been otherwise stated by respondent No.4 in its reply that 1.78 marks for NSS certificate already stand awarded to the petitioner. 16. Admittedly, in the case at hand, petitioner herein, at the first instance, never produced certificate dated 11.1.2021 issued by the Student Welfare Officer, CSKHPKV Palampur, rather same came to be placed on case file for the first time by way of CWP No. 14508 of 2021. It is also not in dispute that at the time of evaluation, petitioner herein had produced NSS certificate (Annexure P-4) issued by CSKHPKV on 3.1.2014, certifying therein that petitioner had attended the NSS Annual Special Camp organized by CSK HPKV at Badehar from 28.12.2013 to 3.01.2014 i.e. 07 days. 17. Question which needs determination at this juncture is whether NSS certificate dated 3.1.2014 (Annexure P-4) adduced on record by the petitioner at the time of evaluation was valid for grant of 01 mark as provided under Part-II (evaluation of 15 marks). 18. Having carefully perused (Annexure P-2) part-II, this Court is persuaded to agree with learned Additional Advocate General that on the basis of afore certificate petitioner could not have been granted 01 mark for her having possessed NSS certificate. Part-II (evaluation of 15 marks) clearly provides that candidate desirous of getting 01 mark for having participated in NSS camp should produce at least one year certificate duly signed by concerned head of institution, which admittedly was not produced at the time of evaluation of documents. 2025:HHC:25750-DB - 13 - 19. Next question which also needs answer is that “whether certificate produced on record by way of CMP No. 14508 of 2021, can be said to be valid NSS certificate or whether on the basis of such document, petitioner herein could be granted additional 01 mark or not?” 20. Having carefully perused certificate dated 11.1.2021, issued under the signature of Student Welfare Officer, vis-à-vis sample of NSS certificate, as reproduced herein above, this Court has no reason to agree with Mr. Dogra, learned senior counsel appearing for the petitioner that petitioner was entitled to be given 01 mark for her having completed three years of NSS as per course curriculum from 2011-12 to 2013-14 session at CSKHPKV, Palampur. By no stretch of imagination, certificate dated 11.1.2021, claimed to be valid by the petitioner, can be said to be NSS certificate of one year, especially when same has not been signed by the competent authority. As per National Service Scheme Manual NSS (Revised), NSS certificate is to be signed by Vice-Chancellor, Programme Coordinator and Principal. If the NSS certificate adduced on record by the petitioner dated 3.1.2014 (Annexure P-4) is perused, same has been signed by Programme Officer (NSS), Programme Coordinator (NSS) and Dean, specifically certifying therein that petitioner has attended the NSS Annual Special Camp organized by CSK HPKV at Badehar from 28.12.2013 to 3.01.2014, however Certificate dated 11.1.2021 is neither signed by 2025:HHC:25750-DB - 14 - the authorities as detailed herein above, nor it specifically certifies that petitioner attended one annual special camp, which is otherwise issued to NSS volunteer who has completed 240 hours of regular activities in the period of two years and attended one annual camp. Leaving everything aside, aforesaid certificate dated 11.1.2021 issued by Student Welfare Officer was never produced at the time of evaluation of the documents, rather same came to be adduced on the case file by way of Misc. Application, as detailed herein above. 21. Though having perused judgments pressed into service by the learned Senior counsel for the petitioner, this Court cannot have any quarrel with the submission made by learned Senior counsel representing the petitioner that in case document required to be produced at the time of interview or evaluation of documents was in possession of the candidate concerned, but he/she failed to produce the same at the time of evaluation of documents or interview, same can be subsequently considered for awarding marks, if any, provided qua the same. However having carefully perused certificate dated 11.1.2021, this Court is not persuaded to agree with learned senior counsel for the petitioner that afore certificate dated 11.1.2021, was valid certificate and as such, same should have been take into consideration by the respondents for awarding 01 additional mark. As has been taken note herein above, document dated 11.1.2021, if seen juxtaposing, model/sample certificate usually issued to NSS volunteer 2025:HHC:25750-DB - 15 - (Annexure P-9) nowhere suggests that same to be NSS certificate, rather same suggests that petitioner while doing basic science successfully completed three years of NSS as per Course Curriculum from 2011-12 to 2013-14 Session. It nowhere suggests that petitioner being NSS volunteer completed 240 hours of regular activities in the period of two years and attended one annual camp, which otherwise in terms of advertisement could only be taken into consideration for awarding 01 additional mark. Had petitioner produced on record valid certificate on prescribed format, certifying therein that petitioner had attended one annual special camp duly signed by Vice Chancellor, Programme Coordinator and Principal, this court would have definitely directed the respondents to award 01 additional mark in light of judgment passed by the Hon’ble Apex Court as detailed herein above. 22. At this stage, it would be apt to take note of relevant extract of Part-II (Evaluation of 15 marks), which has been referred herein above. A careful examination of the criteria outlined in the advertisement clearly indicates that a candidate seeking to obtain one mark must hold an NSS certificate of at least one year, issued by the head of the concerned institution. 23. In the earlier part of the judgment, this Court has reproduced specimen of NSS certificate required to be furnished by the candidate. In the case at hand, admittedly, petitioner had not submitted the certificate for requisite period on a prescribed format 2025:HHC:25750-DB - 16 - alongwith her application. Though during the course of the arguments, Mr. Dogra, tried to persuade this court by referring to the curriculum in four years degree course passed by her, in which she has been shown to have participated in National Service Scheme during the 1st and 2nd years of the course, but since same is not on prescribed format coupled with the fact that it nowhere suggests that petitioner participated in one year NSS training of at least one year that was rightly not considered for grant of 01 mark. Petitioner herein cannot be permitted to take benefit of her own acts and omissions. Once she failed to submit the documents in terms of advertisement coupled with the fact that NSS certificate subsequently adduced on record of this case dated 11.1.2021, cannot be said to be valid on account of its being not on prescribed format and only signed by Student Welfare Officer, CSKHPKV, Palampur. Though it is more than settled that requirement of advertisement is mandatory to fulfill substantially in order to claim right to selection to a particular post, but even if it is presumed that in terms of judgment passed by the Hon’ble Apex Court in judgment (supra), petitioner could be awarded 01 mark on account of her having produced valid certificate of NSS subsequent to evaluation of the documents, petitioner herein cannot be granted 01 mark on the basis of certificate dated 11.1.2021 for the reason that same is neither on prescribed format nor has been signed by competent authority of the concerned university or institution. 2025:HHC:25750-DB - 17 - 24. Though, at this stage, Mr. Dogra, attempted to persuade this Court by referring to curriculum of BSc degree course, whereby she has undergone three years of NSS as per Course Curriculum from 2011-12 to 2013-14 Session at CSKHPKV, Palampur, but having perused curriculum, this Court is not persuaded to agree with Mr. Dogra, for the reason that certificate dated 11.1.2021, does not reflect the exact period of training done by the petitioner and as such, no inference of completion of one year training can be drawn in favour of the petitioner for the reason that it will only be in the realm of hypothesis, meaning thereby, petitioner cannot be held entitled to 01 mark for her having undergone NSS during three years BSc course because she has already been awarded requisite mark for the Minimum Educational Qualification during evaluation process and when such qualification was achieved by her by undergoing the entire three years prescribed curriculum she cannot be allowed to claim one mark for training which was otherwise part of her four years curriculum. She cannot be given marks twice qua the same. 25. Though reply filed by respondent No.6-university suggests that petitioner passed Bachelors in Science in the month of June 2014 and during her afore program, she successfully completed three year attendance of NSS from 2011-12 to 2013-14 and during such course, she was not awarded marks for NSS on the Detailed Marks Certificate and only “S” and “US” grade is awarded because NSS/NCC is non- 2025:HHC:25750-DB - 18 - credit compulsory course and its marks are not awarded, but such fact, if any, may not be of much relevance especially qua the factum of non-grant of 01 additional mark for petitioner’s having possessed certificates of NSS dated 3.1.2014 and 11.1.2021, respectively. 26. It is none of the case of the petitioner that she has been not given weightage for Minimum Educational Qualification as per Recruitment & Promotion Rules, rather petitioner herein, who secured 52 marks in the written examination has been already given 1.78 marks out of 2.5 marks for Basic Science Degree Program. Reliance in this regard is placed upon judgment dated 23.9.2021, passed by the Hon’ble Division Bench in CWP No. 5068 of 2021, titled as Avni Gupta v. Himachal Pradesh Staff Selection Commission and Anr., relevant paras whereof read as under: “16. The claim of the petitioner for 1 mark on account of having undergone 6 months training also deserves to be rejected. She had again failed to submit any document, proving her claim of having undergone 6 months training as required by the Advertisement as well as Notification dated 17.04.2017, which reads as under:- “Part-II (Evaluation of 15 marks) Evaluation of 15 marks in respect of shortlisted candidates after qualifying written objective screening test/subjective tests and skill test/physical/practical tests, if any, will be carried out as per the following criteria:- 10. Training of at least 6 months duration related to the post applied for from a recognized 1(one) Competent authority of the concerned University/Institution. 2025:HHC:25750-DB - 19 - University/Institution. 17. On this count also, petitioner tried to persuade us by referring to the curriculum of her B. Tech degree course, whereby she had undergone training during 1st semester of 4th year. Perusal of curriculum for the 4th year of B. Tech course undertaken by the petitioner reveals that it prescribes training during 1st semester, but it does not reflect the exact period of training having undergone by the petitioner. No inference of completion of 6 months training can be drawn in favour of petitioner for the reason that it will only be in the realm of hypothesis. Even otherwise, petitioner cannot be held entitled to 1 mark for having undergone above noted training during 1st semester of 4th year of B. Tech course for the reason that she had already been awarded requisite marks for the minimum educational qualifications during evaluation process and when such qualification was achieved by her by undergoing the entire 4 year prescribed curriculum, she cannot be allowed to claim 1 mark for training which was part of her 4 year curriculum. She cannot get the marks twice for the same thing.” 27. In the aforesaid judgment, Division Bench of this Court did not hold the petitioner therein entitled to 01 mark whose claim was also on similar lines that her course of B.Tech contained integrated course of NSS. Applying same analogy in the present case, this Court is of the definite view that the petitioner is not entitled to 01 mark for NSS course as neither certificate on proper format has been submitted nor petitioner has been able to show that she has attended one year NSS course during BSc. 2025:HHC:25750-DB - 20 - 28. Consequently, in view of the detailed discussion made herein above, this court finds no merit in the present petition, and as such, same is dismissed being devoid of any merit.
