Heard Mr. G. Bharadwaj, learned counsel for the petitioner. This application has been filed under Article 227 of the Constitution of India challenging the order dated 15.02.2025 passed by the learned Civil Judge (Junior Division), Bajali, Pathsala in T.S. No. 38/2014. The petitioner is the plaintiff before the trial court. He filed evidence of some of his witnesses. PW-1 was partly cross-examined. Thereafter, the petitioner/plaintiff prayed for adjournment and the trial court, for certain reasons, refused to grant adjournment and dismissed the suit. I have considered the submission made by the learned counsel for the petitioner. Whenever a trial court closes hearing of evidence of the plaintiff side, the trial court should give opportunity to the defendant to give evidence. Moreover, it appears from the impugned order that the trial court incorrectly oriented itself and arrived at a wrong finding.
Therefore, the impugned order dated 15.02.2025 passed by the learned Civil Judge (Junior Division), Bajali, Pathsala in T.S. No. 38/2014 is bad in law and stands set aside. Page No.# 4/4 The suit of the petitioner shall be restored to file. The trial court shall give opportunity to the plaintiff to complete his cross-examination. Thereafter, the trial court shall also give adequate opportunity to the petitioner/plaintiff to cross-examine his more witnesses, if so desired. After that, the trial court shall proceed to dispose of the case in accordance with law. With the above, the present civil revision petition is disposed of. JUDGE Comparing Assistant
