Mr. Deepak Mishra, learned Additional Government Advocate-I appears on behalf of the State. 2. In compliance with the order dated 16.09.2025, the office have submitted a report dated 27.10.2025, saying that the appellant, Raghunath, has died. The office report aforesaid is based upon a report submitted by the learned Chief Judicial Magistrate, Budaun vide memo dated 29.09.2025. The material part of the report submitted by the learned Chief Judicial Magistrate, Budaun reads : " माननीय उच्च न्यायालय के आदेशानुपालन में अपीलाथीर्/अिभयुक्त रघुनाथ पुत्र मुकु ट िसह िनवासी ग्राम िमलपीर (िमलिकया) थाना उसावाँ िजला बदायूँ के जीवन मृत्यु होने के संबध में विरष्ठ पुिलस अधीक्षक को पत्र प्रेिषत िकया गया। संबंिधत थानाध्यक्ष/प्रभारी िनरीक्षक की इस आशय आख्या प्रस्तुत की अपीलाथीर्/अिभयुक्त रघुनाथ पुत्र मुकु ट िसह िनवासी ग्राम िमलपीर ( िमलिकया) थाना उसावाँ िजला बदायूँ की मृत्यु हो चुकी है। समर्थन में ग्राम प्रधान की तहरीर सग्लंन है। उपरोक्त के संबन्ध में ग्राम प्रधान व सािक्षयों के ब्यानों की छायाप्रित संग्लन है। माननीय उच्च न्यायालय इलाहाबाद के पिरपत्र संख्या 15/2005: VIIIb-119 िदनांिकत 19.04.2005 और पिरपत्र संख्या 04/एडिमन-जी-11 िदनांिकत 18.01.2017 के अनुपालन में साक्षीगण के बयान अिभिलिखत िकये गये। िजनमें अपीलाथीर्/अिभयुक्त रघुनाथ Versus Counsel for Appellant(s) : P.C. Sharma Counsel for Respondent(s) : D.G.A. Raghunath .....Appellant(s) State of U.P. .....Respondent(s) पुत्र मुकु ट िसह िनवासी ग्राम िमलपीर (िमलिकया) थाना उसावाँ िजला बदायूँ की मृत्यु पुिष्ट की गयी। " 3. A perusal of the annexed papers, particularly, the report from the Police Station Usawa, District Budaun dated 26.09.2025 and the statement of the appellant's son, Ram Kumar, show that the appellant died of some ailment 25 years ago. 4.
