(Presently Confined In Central Alwar). ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Anish Bhadala For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 24/07/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.343/2024 registered at Police Station- Thanagaji, District Alwar for offences under Sections 189(2), 115(2), 126(2), 352, 351(2), 87 and 332(c) of BNS. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the victim is wife of the accused-petitioner, which is evident from another FIR lodged by the victim bearing FIR No.325/2024, P.S. Thanagaji, District Alwar on 01.11.2024. The fact of marriage was also mentioned in the bail order dated 25.02.2025 of the Coordinate Bench of this Court. Now this FIR has been lodged by the father of his wife on false and concocted ground. Co-accused- [2025:RJ-JP:27829] (2 of 2) [CRLMB-5680/2025] Rohitash has been released on bail by Coordinate Bench of this Court on 25.02.2025. Petitioner is behind the bars since 24.12.2024. Charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and especially the arguments advanced by learned counsel for the petitioner but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Ravi Prajapat S/o Sharwan Kumhar shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
