(Oral) The applicant is in judicial custody in FIR No.26 of 2025, dated 15.01.2025, under Sections 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Bazpur, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 15.01.2025, police spotted two persons and suspected their activities. Seeing the police, they started ran away. They were intercepted by the police and 300.1 Grams Charas was recovered from the co-accused. The FIR records that both, the applicant and the co-accused revealed that they had come to sell the Charas. 2 4. Learned counsel for the applicant would submit that nothing was recovered from him; he has been falsely implicated in the case. 5. Learned State counsel would submit that Charas was recovered from the possession of the co- accused, who has also tried to run away from the place of incident. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount; to the satisfaction of the court concerned.
