------ Md. Masum Ansari @ Masum, aged about 19 years, son of Md. Shhwarish @ Md. Sawarish Warsi, resident of Jhirkey Basti, Kathara, P.O. –Kathara, P.S. –Gomia, District –Bokaro.
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Pankaj Verma, Advocate For the State
: Mr. Tarun Kumar, Addl. P.P. ------
Order No.02 Dated- 21.07.2025
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Bokaro Steel City P.S. Case No.39 of 2025 registered for the offences punishable under sections 317(2)/317(4)/317(5)/338/336(3)/340(2)/3(5) of the B.N.S., 2023.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner is a leader of motorcycle thieves and led to discovery of huge number of motorcycles, the photograph of which has been part of the F.I.R. It is further submitted that the allegations against the petitioner are all false. It is then submitted that the petitioner is also involved in two other cases of course, the details of which has not been furnished by the petitioner. It is next submitted that the petitioner has been in custody since 12.03.2025, as has been mentioned in paragraph no. 01 of the bail application. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the fact that the petitioner is a leader of the gang of thieves and in an organized manner is committing theft of motorcycles and selling the same after changing the number plates and tempering with the engine and chassis number as well as the petitioner is a threat to the law
and order situation in the locality, therefore there is every chance of the petitioner absconding, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner of committing theft of huge number of motorcycles in an organized manner and the chances of his tampering with the evidence and absconding if released on bail is also his criminal antecedent, this Court is of the considered view that this is not a fit case where the above-named petitioner be admitted to bail.
Accordingly, the prayer for bail of the above-named petitioner is rejected.
