Heard learned counsel for the petitioner and Sri Ajay Singh,learned counsel for the respondents. 2. It is argued by learned counsel for the petitioner that the claim of the petitioner has been rejected by the respondent No.3/Divisional Incharge, Oriental Insurance Company, Agra vide order dated 27.06.2019. Aggrieved with the aforesaid order, the petitioner submitted a representation before the respondent No.2/District Magistrate, Mainpuri on 30.09.2019 copy of the same is appended as Annexure No.7 to the writ petition. 3. On the other hand, it is argued by Sri Ajay Singh,learned counsel for the respondents that as per Clause 6 of Mukhyamantri Kisan and Sarvhit Bima Yojna, the representation was referred before the the District Level Committee, constituted and headed by the District Magistrate and the District Magistrate is the competent authority to take decision in the matter.The relevant portion of Clause 6 reads as follows:- यिद दावे में िकसी प्रकार की िडस्क्रे पेन्सी पायी जाती है या कोई िववाद उत्पन्न होता है तो उस दशा में दावे की जांच जरूरी होगी तथा उस जांच आख्या को िजलािधकारी की अध्यक्षता में बनायी गयी सिमित के समक्ष एक माह के अन्दर प्रस्तुत िकया जायेगा। िजलािधकारी की अध्यक्षता में बनायी गयी सिमित में मुख्य िवकास अिधकारी, मुख्य िचिकत्सािधकारी, अपर िजलािधकारी (िवत्त एवं राजस्व), उप िजलािधकारी सदस्य होगें तथा बीमा कम्पिनयों के प्रितिनिधयों को भी आमंित्रत िकया जायेगा। सिमित सभी लिम्बत एवं िडस्क्रे पेन्ट/िववािदत दावों के संबंध में िनणर्य लेगी तथा बीमा कम्पनी उस िनणर्य के अनुसार 01 माह के अन्तगर्त दावे के भुगतान के िलए बाध्य होगी। 4. In response to the same, it is argued by learned counsel for the petitioner that the aforesaid representation is still pending before District Level Committee constituted and headed by the respondent No.2 and till date no decision has been taken in the matter. He also placed reliance Versus Counsel for Petitioner(s) : Sharad Chand Rai Counsel for Respondent(s) : Ajay Singh Smt Bhuri Devi .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) upon the judgement and order dated 03.11.2023 passed by this Court in the case of Neeva Vs. State of U.P. and others (Writ C No.38033 of 2023). 5. Heard learned counsel for the parties and perused the record. 6. In the facts and circumstances of the case, the present petition is disposed of directing the respondent No.2/District Magistrate, Mainpuri to take a decision in the matter most expeditiously and preferably within a period of six weeks from the date of production of certified copy of this order. 7. It is made clear that the order dated 27.06.2019 passed by the respondent No.3/Divisional Incharge, Oriental Insurance Company, Agra will be subject matter of the decision taken by the respondent No.2.
