Neutral Citation No. - 2025:AHC:32354 Court No. - 1 Case :- CONTEMPT APPLICATION (CIVIL) No. - 591 of 2025 Applicant :- Dinesh Kumar Singh Opposite Party :- Awadh Kishore Singh, District Inspector Of Schools, And Another Counsel for Applicant :- Adarsh Singh,Indra Raj Singh Counsel for Opposite Party :- Ashok K Pandey Hon'ble Salil Kumar Rai,J. In pursuance to the previous order passed by this Court, the opposite parties have filed their compliance affidavits disclosing that an order has been passed by the Regional Selection Committee rejecting the claim of the applicant for regularization of his service and consequently for payment of salary. It transpires from the record and from the arguments at the Bar that in Writ - A No. 19861 of 2023, the applicant had challenged the orders dated 04.10.2023 and 16.10.2023 rejecting the regularization of the applicant and also terminating his services. During the pendency of the writ petition, no order was passed granting any interim protection to the applicant and consequently the order dated 16.10.2023 was operative. Evidently, the applicant was not working after 16.10.2023. The petition, i.e., Writ - A No. 19861 of 2023 was allowed by order dated 11.12.2024 and the orders dated 04.10.2023 and 16.10.2023 were set aside. It is the claim of the applicant that despite the aforesaid order, the applicant was not allowed to join. In the compliance affidavit filed today, the opposite parties have stated that vide order dated 04.03.2025, the claim of the applicant for regularization has been rejected. The claim of the applicant so far as salary is concerned, can only be for January, 2025 and February, 2025. On the admission of the applicant himself, the applicant did not work and was not allowed to join in pursuance to the order dated
11.12.2024. In view of the aforesaid, it is not a case to proceed under the Contempt of Courts Act, 1971 for non-payment of salary for the month of January and February, 2025.
As the order passed by the Writ Court has been complied by the opposite parties, no further orders are required to be passed in the present contempt application. The application is disposed of and consigned to records. Notices issued to the opposite parties are discharged.
