Heard learned counsel for the applicants and learned AGA for the State. 2. This application has been filed by applicants for setting aside the order dated 11.12.2024 passed in Case No.231 of 2016, (Ramnath Versus M/s Ayushi Enterprises U.P.) Under Section 138 N.I. Act, Police Station-Kotwali, District-Allahabad, by means of which Non-Bailable Warrant has been issued against Applicant by trail court, pending in the court of Additional Chief Judicial Magistrate-X, Allahabad. 3. It is submitted by learned counsel for applicant that by means of impugned order dated 11.12.2024 non bailable warrant has been issued against applicant for non appearance before the court concerned. Learned counsel for applicant submits that applicant could not appear before the court concerned since August 2024 and undertakes to remain present before the court concerned on the next date and will participate in the trial court proceedings and will not seek unnecessary adjournment. 4. In view of statement made by learned counsel for applicant, applicant is directed to appear before the court concerned on or before 20.11.2025 and shall participate in the trial court Versus Counsel for Applicant(s) : Abhishek Kumar Mishra Counsel for Opposite Party(s) : G.A. Usha Sharma .....Applicant(s) State of U.P. and Another .....Opposite Party(s) proceeding. In the event, applicant appears before the court concerned on or before the date fixed as stated hereinabove, non bailable warrant issued against applicant shall be kept in abeyance. However, the trial court would be at liberty to execute non bailable warrant in the event applicant does not appear before the trial court or fails to participate in the trial court proceedings. 5.
