Appellant/Collector of Customs is represented by the learned advocate. 2. Nobody is present on behalf of the accused/respondent. 3. In pursuance of the direction passed by this Court, a report is submitted by the S.I. of Police, New Market P.S. indicating that during pendency of this appeal, the sole accused/respondent was expired on 12.09.2009. A photocopy of certificate of death of the said accused/respondent is collected and tagged with the report which also affirms the death of the said accused/respondent, Sheikh Mohammad. 4. The instant appeal is preferred at the behest of the appellant challenging the impugned judgment and order of acquittal passed by the learned Trial Court in connection with Sessions Case No. 16 of 1991. 5. As the sole accused/respondent has already been expired, the instant appeal stands abated against him. 2 6. Accordingly, the instant appeal being CRA 240 of 1993 is hereby dismissed as abated. 7. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately. 8.
