Heard Sri Kailash Singh Yadav, learned counsel for the petitioner, Sri Rajesh Kumar Tiwari, learned Additional Chief Standing Counsel for the State and Sri Bhupendra Kumar Tripathi, learned counsel for the Gaon Sabha. 2. The instant public interest litigation has been filed for the following relief:- "1. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to 4 to initiate the appropriate proceeding under Section 67 of U.P. Revenue Code for the removed of illegal encroachment over the Public Utility Property Land as recorded in Revenue Record as Pond land of Araji No.187 area 0.153 Hectare situated at village Malikpur, Pargana and Tehsil Saidpur, District Ghazipur." 3. Learned counsel for the petitioner submitted that in view of the entry of the plot in question, an appropriate proceedings be initiated against the private respondents. The Annexure No.3 annexed along with instant petition fully demonstrate that proceedings under Section 67 of U.P. Revenue Code, 2006 has already been registered as Case No.T202514290407019 before the Tehsildar, Saidpur, District Ghazipur in respect to plot No.187 area 0.153 hectare. 4. Considering the facts that the proceedings under Section 67 of U.P. Revenue Code, 2006 has already been registered before the respondent Versus Counsel for Petitioner(s) : Kailash Singh Yadav Counsel for Respondent(s) : Bhupendra Kumar Tripathi, C.S.C. Prakash Pal .....Petitioner(s) State Of Up And 8 Others .....Respondent(s) no.4-Tehsildar, Saidpur, Ghazipur, the instant public interest litigation is finally disposed of directing the respondent no.4-Tehsildar, Saidpur, Ghazipur, to decide the aforementioned pending proceedings expeditiously after affording opportunity of hearing to the parties.
